This is responsive to the Office Action mailed November 30, 2012. In the Office Action, the Examining Attorney rejected the mark based upon Registration No. 3,104,710. Attached as Exhibit A is a status report from TSDR indicating that Registration No. 3,104,710 was canceled as of January 18, 2013. Accordingly, this mark no longer is a bar to registration of Applicant’s mark and a Notice of Publication is respectfully solicited.
