DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

ISSUES APPLICANT MUST ADDRESS:  On March 15 2013, the trademark examining attorney and Dennis Krize discussed the issues below.  Applicant must timely respond to these issues.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.

 

 

             A.       Applicant does not appear to be the owner of the mark

 

 

Registration is refused because applicant does not appear to have been the owner of the mark as of the filing date of the application.  Trademark Act Section 1, 15 U.S.C. §1051; see TMEP §1201.02(b).  The application identifies the owner of the mark as Nicolas Holiday Inc., however, the attached evidence, namely, the specimen shows that the owner of the mark appears to be General Electric.

 

An application must be filed by the party who owns or is entitled to use the mark as of the application filing date.  TMEP §§1201, 1201.02(b); see 15 U.S.C. §1051.  If the identified applicant does not own or is not entitled to use the mark on the application filing date, the application is void.  See 37 C.F.R. §2.71(d); Huang v. Tzu Wei Chen Food Co., 849 F.2d 1458, 1459-60, 7 USPQ2d 1335, 1335-36 (Fed. Cir. 1988); Great Seats, Ltd. v. Great Seats, Inc., 84 USPQ2d 1235, 1239 (TTAB 2007); Am. Forests v. Sanders, 54 USPQ2d 1860, 1862-64 (TTAB 1999), aff’d, 232 F.3d 907 (Fed. Cir. 2000); TMEP §1201.

 

Applications filed in the name of the wrong party cannot be cured by amendment or assignment.  See 37 C.F.R. §2.71(d); TMEP §803.06.

 

A new specimen showing the mark in use by the applicant would be acceptable.
