SEARCH OF OFFICE RECORDS
The Office records have been searched and there are no similar registered or pending marks that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
However, applicant must respond to each refusal and/or requirement set forth below.
IDENTIFICATION OF GOODS
Applicant has identified the goods in the application as: (CLASS 9) surveillance camera support devices for housing and protecting cameras, namely, tilt heads, pan and tilt heads and camera housings; motorized camera positioning equipment, namely, pan/tilts, tv cameras and tv monitors, and electronic controls therefor; and tripods, pedestals and brackets for lasers, thermal imaging devices, telescopes, transits, theodolites, bore scopes, microwave, radar and radio antennas; electrical controllers, control systems comprising electrical controllers, gears and housings for tripods and pan and tilts, integrated camera positioning systems comprising, unitary photographic cameras and pan and tilts, internal pan and tilt electrical controllers, and camera control systems, comprising electrical controllers, gears and housings for pan and tilts.
The identification of goods as presently worded is indefinite and/or requires clarification. See TMEP §1402.01. Applicant must amend the identification using the common commercial or generic name for the goods whenever possible. Suggested wording for amending the identification is provided in CAPS below.
The wording pan/tilts positioning equipment requires clarification. Applicant may adopt the following PAN AND TILT MOUNTS. See example below.
The wording tripods, pedestals and brackets for lasers, thermal imaging devices, telescopes, transits, theodolites, bore scopes, microwave, radar and radio antennas is too broad and indefinite. Applicant must specify the nature or type of laser(s), e.g., NON-MEDICAL LASER (Class 9). In addition, applicant must indicate that the thermal imaging devices are NON-MEDICAL THERMAL IMAGING DEVICES. Applicant must also indicate that the “transits” are TRANSIT TELESCOPES, if accurate, and the “bore scopes” are NON-MEDICAL BORESCOPES; and that “microwave” refers to MICROWAVE ANTENNA, if accurate. And, “radar” refers to RADAR DETECTORS, if accurate. If accurate, applicant may adopt the following MOUNTS AND SUPPORTS IN THE NATURE OF tripods, pedestals and brackets for NON-MEDICAL lasers, NON-MEDICAL thermal imaging, telescopes, transit TELESCOPES, theodolites, NON-MEDICAL borescope OPTICAL DEVICES, microwave ANTENNA, radar DETECTORS and radio antennas. See example below.
The wording control systems is indefinite. Applicant must indicate the purpose or use of the control systems, e.g., CONTROL SYSTEMS FOR SURVEILLANCE CAMERAS.
The wording gears and housings for tripods and pan and tilts, requires clarification for proper understanding of the nature of these goods. Specifically, if the gears and housings are electronic and/or electrical in nature, applicant must so specify. See example below. The same applies to the wording gears and housings for pan and tilts. See example below.
The wording pan and tilts must be clarified to indicate that these are types of MOUNTS AND/OR SUPPORTS where the preamble of the identification does not so indicate. See example below.
Applicant may adopt the following, if accurate:
