The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

IDENTIFICATION OF GOODS

 

The identification of goods is indefinite and must be clarified to indicate the function/purpose of the social media applications, e.g., “downloadable software in the nature of a mobile application in the field of social media, namely, for sending status updates to subscribers of web feeds, uploading and downloading electronic files to share with others,” etc.  The “with accompanying websites” language is also indefinite as this looks to be a Class 042 service instead of a good, e.g., “providing a website featuring technology in the field of social media, namely, that enables users to send status updates to subscribers of web feeds, upload and download electronic files to share with others,” etc.  The “mobile-based dating, match-making application” wording also requires clarification as to whether the software is downloadable or not, e.g., “downloadable software in the nature of a mobile application for internet-based dating and match-making.”

Applicant may adopt the following amended identification, if accurate:

 

  • Downloadable software in the nature of a mobile application in the field of social media, namely, for {SPECIFY functions, e.g., sending status updates to subscribers of web feeds, uploading and downloading electronic files to share with others, etc.}; downloadable software in the nature of a mobile application for internet-based dating and match-making   [INT. CLASS 009]

 

  • Providing a website featuring technology in the field of social media, namely, {SPECIFY functions, e.g., that enables users to send status updates to subscribers of web feeds, upload and download electronic files to share with others, etc.}  [properly in INT. CLASS 042]

 

An applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.

CLASSIFICATION OF GOODS/SERVICES

 

If applicant adopts the suggested amendment of the identification of goods and/or services, then applicant must amend the classification to add International Class 042 as shown above.  See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§805, 1401.

 

MULTIPLE-CLASS APPLICATION REQUIREMENTS

 

The application identifies goods and/or services that are classified in at least two classes; however, the fees submitted are sufficient for only one class.  In a multiple-class application, a fee for each class is required.  37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.

 

Therefore, applicant must either (1) restrict the application to the number of classes covered by the fee(s) already paid, or (2) submit the fees for the additional class(es). 

 

For an application with more than one international class, called a “multiple-class application,” an applicant must meet all of the requirements below for those international classes based on an intent to use the mark in commerce under Trademark Act Section 1(b):

 

(1)       LIST GOODS AND/OR SERVICES BY INTERNATIONAL CLASS:  Applicant must list the goods and/or services by international class; and

 

(2)       PROVIDE FEES FOR ALL INTERNATIONAL CLASSES:  Applicant must submit an application filing fee for each international class of goods and/or services not covered by the fee(s) already paid (confirm current fee information at http://www.uspto.gov, click on “View Fee Schedule” under the column titled “Trademarks”).
