Registration of the applied-for mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 1575118 and 1723703.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.  See the enclosed registrations.

 

The applicant has applied to register CRUSADER in standard-character form for:

 

clothing, namely, t-shirts, shirts, tank tops, thermal shirts, long sleeve shirts, short sleeve shirts, woven shirts, polo shirts, jackets, leather jackets, pants, denim jeans, denim jackets, denim shorts, jeans, shorts, board shorts, sweatshirts, hooded shirts, hooded sweatshirts, hats, caps, footwear

 

During preliminary review of the application, the Office classified the applicant’s goods in Class 25.

 

The registered marks, owned by two different entities, are the following:

 

Registration No. 1575118 is AMERICAN CRUSADER in typed-drawing form for “CLOTHING, namely, MEN'S AND [sic] PANTS, SHIRTS, AND TOPS,” in Class 25.

 

Registration No. 1723703 is CRUSADERS in typed-drawing form for goods in Classes 16 and 25, including “clothing; namely, T-shirts, sweat shirts, jerseys, jackets, caps, hats, gym shorts, undergarments, socks,” in Class 25.

 

Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely that a potential consumer would be confused or mistaken or deceived as to the source of the goods and/or services of the applicant and registrant.  See 15 U.S.C. §1052(d).  The court in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to be considered when determining whether there is a likelihood of confusion under Section 2(d).  See TMEP §1207.01.  However, not all the factors are necessarily relevant or of equal weight, and any one factor may be dominant in a given case, depending upon the evidence of record.  Citigroup Inc. v. Capital City Bank Grp., Inc., 637 F.3d 1344, 1355, 98 USPQ2d 1253, 1260 (Fed. Cir. 2011); In re Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont, 476 F.2d at 1361-62, 177 USPQ at 567.

 

In this case, the following factors are the most relevant:  similarity of the marks, similarity of the goods, and similarity of trade channels of the goods.  See In re Dakin’s Miniatures Inc., 59 USPQ2d 1593 (TTAB 1999); TMEP §§1207.01 et seq.

 

Comparison of the Goods

 

The applicant’s goods and the goods in the cited registrations are all a variety of ordinary clothing items.  Thus, the applicant’s goods are closely related to the goods in the cited registrations.

 

Decisions regarding likelihood of confusion in the clothing field have found many different types of apparel to be related goods.  Cambridge Rubber Co. v. Cluett, Peabody & Co., 286 F.2d 623, 624, 128 USPQ 549, 550 (C.C.P.A. 1961) (women’s boots related to men’s and boys’ underwear); Jockey Int’l, Inc. v. Mallory & Church Corp., 25 USPQ2d 1233, 1236 (TTAB 1992) (underwear related to neckties); In re Melville Corp., 18 USPQ2d 1386, 1388 (TTAB 1991) (women’s pants, blouses, shorts and jackets related to women’s shoes); In re Pix of Am., Inc., 225 USPQ 691, 691-92 (TTAB 1985) (women’s shoes related to outer shirts); In re Mercedes Slacks, Ltd., 213 USPQ 397, 398-99 (TTAB 1982) (hosiery related to trousers); In re Cook United, Inc., 185 USPQ 444, 445 (TTAB 1975) (men’s suits, coats, and trousers related to ladies’ pantyhose and hosiery); Esquire Sportswear Mfg. Co. v. Genesco Inc., 141 USPQ 400, 404 (TTAB 1964) (brassieres and girdles related to slacks for men and young men).

 

Registration No. 1575118

 

In this case, most of the applicant’s goods are specifically encompassed by the goods in Registration No. 1575118.  Additionally, the applicant’s goods are not limited to a particular audience and would thus include all of the specified items for men.

 

As to the remaining goods in the applicant’s identification (jackets, leather jackets, denim jackets, denim shorts, shorts, board shorts, hats, caps, and footwear), the trademark examining attorney has attached evidence from the USPTO’s X-Search database consisting of 10 third-party marks registered for use in connection with the same or similar goods along with pants, shirts, and tops, the types of goods in the cited registration.  This evidence shows that the goods listed therein, are of a kind that may emanate from a single source under a single mark.  See In re Anderson, 101 USPQ2d 1912, 1919 (TTAB 2012); In re Albert Trostel & Sons Co., 29 USPQ2d 1783, 1785-86 (TTAB 1993); In re Mucky Duck Mustard Co., 6 USPQ2d 1467, 1470 n.6 (TTAB 1988); TMEP §1207.01(d)(iii).

In this case, most of the applicant’s goods are specifically encompassed by the goods in Registration No. 1723703.  Additionally, the applicant’s shorts are broad enough to encompass the registrant’s gym shorts.

 

As to the remaining goods in the applicant’s identification (pants, denim jeans, denim shorts, jeans, board shorts, footwear), the trademark examining attorney has attached evidence from the USPTO’s X-Search database consisting of 10 third-party marks registered for use in connection with the same or similar goods along with jerseys, jackets, caps, hats, gym shorts, undergarments, and socks, the types of goods in the cited registration.  This evidence shows that the goods listed therein, are of a kind that may emanate from a single source under a single mark.  See In re Anderson, 101 USPQ2d 1912, 1919 (TTAB 2012); In re Albert Trostel & Sons Co., 29 USPQ2d 1783, 1785-86 (TTAB 1993); In re Mucky Duck Mustard Co., 6 USPQ2d 1467, 1470 n.6 (TTAB 1988); TMEP §1207.01(d)(iii).

Turning to the comparison of the channels of trade, neither the application nor the registrations contains any limitations regarding trade channels for the goods and therefore it is assumed that registrant’s and applicant’s goods are sold everywhere that is normal for such items, i.e., clothing and department stores.  Thus, it can also be assumed that the same classes of purchasers shop for these items and that consumers are accustomed to seeing them sold under the same or similar marks.  See Kangol Ltd. v. KangaROOS U.S.A., Inc., 974 F.2d 161, 23 USPQ2d 1945 (Fed. Cir. 1992); In re Smith & Mehaffey, 31 USPQ2d 1531 (TTAB 1994); TMEP §1207.01(a)(iii).

 

Comparison of the Marks

 

Where the goods and/or services of an applicant and registrant are “similar in kind and/or closely related,” the degree of similarity between the marks required to support a finding of likelihood of confusion is not as great as in the case of diverse goods and/or services.  In re J.M. Originals Inc., 6 USPQ2d 1393, 1394 (TTAB 1987); see Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1242, 73 USPQ2d 1350, 1354 (Fed. Cir. 2004); TMEP §1207.01(b).

 

Registration No. 1575118

 

The applicant’s mark CRUSADER is similar in commercial impression to the registered mark AMERICAN CRUSADER.

 

Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.  In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012) (quoting In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973)); TMEP §1207.01(b)-(b)(v).  Similarity in any one of these elements may be sufficient to find the marks confusingly similar.  In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc., 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b).

 

When comparing marks, the test is not whether the marks can be distinguished in a side-by-side comparison, but rather whether the marks are sufficiently similar in their entireties that confusion as to the source of the goods and/or services offered under applicant’s and registrant’s marks is likely to result.  Midwestern Pet Foods, Inc. v. Societe des Produits Nestle S.A., 685 F.3d 1046, 1053, 103 USPQ2d 1435, 1440 (Fed. Cir. 2012); Edom Labs., Inc. v. Lichter, 102 USPQ2d 1546, 1551 (TTAB 2012); TMEP §1207.01(b).  The focus is on the recollection of the average purchaser, who normally retains a general rather than specific impression of trademarks.  L’Oreal S.A. v. Marcon, 102 USPQ2d 1434, 1438 (TTAB 2012); Sealed Air Corp. v. Scott Paper Co., 190 USPQ 106, 108 (TTAB 1975); TMEP §1207.01(b).

 

In this case, the additional term AMERICAN in the registered mark would be viewed as indicating the origin of the goods.  Since the applicant’s goods will also be sold in the United States, consumers are likely to assume that due to the common term CRUSADER, both parties’ marks identify the same source of goods.

 

Registration No. 1723703

 

The applicant’s mark CRUSADER is virtually identical to the registered mark CRUSADERS.

 

Trademarks and/or service marks consisting of the singular and plural forms of the same term are essentially the same mark.  See Wilson v. Delaunay, 245 F.2d 877, 878, 114 USPQ 339, 341 (C.C.P.A. 1957) (finding no material difference between the singular and plural forms of ZOMBIE such that the marks were considered the same mark); In re Pix of Am., Inc., 225 USPQ 691, 692 (TTAB 1985) (noting that the pluralization of NEWPORT is “almost totally insignificant” in terms of likelihood of confusion among purchasers); In re Sarjanian, 136 USPQ 307, 308 (TTAB 1962) (finding no material difference between the singular and plural forms of RED DEVIL).

 

Overall, the marks have the same commercial impression.

 

Since the marks are similar and the goods are closely related, there is a likelihood of confusion as to the source of applicant’s goods.  Therefore, applicant’s mark is not entitled to registration.

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration.

 

ADVISORY – Grace Period

 

The applicant is advised that maintenance documents are due for cited registration, U.S. Registration No. 1723703.  However, suspension is appropriate only when the application is in condition for final action and the cited registration is in the six-month grace period for filing registration maintenance documents or that grace period has passed but the USPTO automated records have not yet been updated to indicate that such documents have been filed and accepted.  TMEP §716.02(e). 

 

To avoid inadvertent cancellation or expiration of a registration due to a delay in processing maintenance documents, the USPTO’s policy is to wait until 30 days after expiration of the grace period before updating its automated records to show that a registration has been cancelled or expired.  Id.

 

Applicant must also respond to the requirement set forth below.

 

Clarification of Entity Data

 

The applicant is identified as follows:

 

Brown, John, L, a California sole proprietorship.

 

In addition to the applicant name and U.S. state provided, however, applicant must also specify the name and national citizenship of the individual person who is the sole proprietor.  TMEP §803.03(a).

 

The following format for identifying a sole proprietorship should be used: 

 

name of sole proprietorship>, a <identify U.S. state or country where sole proprietorship is registered to do business> sole proprietorship, composed of <name of individual>, a citizen of <country of citizenship>.

 

TMEP §803.03(a).  The name of the sole proprietorship and the name of the individual can be the same. 

 

If, rather than a sole proprietorship, applicant is instead an individual person doing business under an assumed business name, then the following format should be used: 

 

<name of individual>, a citizen of <country of citizenship>, doing business as <assumed business name>.

 

TMEP §§803.02(a), 803.04.

 

If, in response to the above request, applicant provides information indicating that it is not the owner of the mark, registration will be refused because the application was void as filed.  See 37 C.F.R. §2.71(d); TMEP §§803.06, 1201.02(b).  An application must be filed by the party who owns or is entitled to use the mark as of the application filing date.  TMEP §§1201, 1201.02(b).

 

Response Guidelines

For this application to proceed toward registration, applicant must explicitly address each refusal and/or requirement raised in this Office action.  If the action includes a refusal, applicant may provide arguments and/or evidence as to why the refusal should be withdrawn and the mark should register.  Applicant may also have other options for responding to a refusal and should consider such options carefully.  To respond to requirements and certain refusal response options, applicant should set forth in writing the required changes or statements. 

 

If applicant does not respond to this Office action within six months of the issue/mailing date, or responds by expressly abandoning the application, the application process will end, the trademark will fail to register, and the application fee will not be refunded.  See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a), 2.68(a), 2.209(a); TMEP §§405.04, 718.01, 718.02.  Where the application has been abandoned for failure to respond to an Office action, applicant’s only option would be to file a timely petition to revive the application, which, if granted, would allow the application to return to live status.  See 37 C.F.R. §2.66; TMEP §1714.  There is a $100 fee for such petitions.  See 37 C.F.R. §§2.6, 2.66(b)(1).

 

Responses to Office actions must be properly signed.  See 37 C.F.R. §§2.62(b), 2.193(e)(2); TMEP §§712, 712.01.   Where an applicant is not represented by an attorney, the response must be signed by the individual applicant or someone with legal authority to bind a juristic applicant (e.g., a corporate officer or general partner).  See 37 C.F.R. §2.193(e)(2)(ii); TMEP §§611.03(b), 611.06(b)-(h), 712.01.
