APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by Oscar Alcantara on January 2, 2013, the trademark examining attorney has amended the application as indicated below. Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
The class 29 identification of goods is amended to read as follows: Processed foods, namely frozen and dried fruits and vegetables containing herbs, vitamins and minerals; fruit based meal replacement bars for boosting energy.
The class 41 recitation of services is amended to read: Educational and entertainment services provided via all forms of electronic transmission, namely electronic newsletters featuring news and commentary in the field of nutrition, health and wellness; publishing; electronic publishing; organization of competitions for education and/or entertainment; educational information services and on-line information services, namely offering classes relating to health, personal care; arranging and conducting educational and health seminars and workshops; arranging and conducting health education services; arranging and conducting of educational medical conferences and seminars; health club services; medical teaching services; production of radio, television, film and videos relating to health and personal care.
The remainder of the identification of goods and services is acceptable as written.
The description of the mark is amended to read: The mark consists of the word element SWISSE in white within a black oval, within a red rectangular field.
