APPLICATION HAS BEEN AMENDED: The trademark examining attorney is amending the application as follows. No prior approval or authorization from applicant or applicant’s attorney is required. TMEP §707.02. Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707.
First, it is noted for applicant that the response of March 25, 2013 has been received, accepted and the amendments made of record. That is, the refusal of registration under Section 2(e)(4) of the Trademark Act is withdrawn in view of the amendment to seek registration pursuant to Section 2(f) based on ownership of prior Registration No. 3741509. Moreover, the substitute specimen for Class 1 and the verification thereof are also accepted and made of record, and the refusal under Sections 1 and 45 are also accordingly withdrawn.
However – for clarification of the record, the trademark examining attorney makes the following clerical corrections:
In the application itself, in the section for specifying the “Literal Element” of the mark, applicant mistakenly wrote “DuPont inside an oval”. In that this section asks only for the literal, or written, portion of the mark, this is amended to read merely “DUPONT”.
It is noted that the description of the mark remains unchanged – namely, “The mark consists of the word DuPont inside an oval.”
