The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62, 2.65(a); TMEP §§711, 718.03.

Information regarding pending Application Serial No. 85522260 is enclosed.  The effective filing date of the referenced application precedes applicant’s filing date.  There may be a likelihood of confusion between the two marks under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  If the referenced application registers, registration may be refused in this case under Section 2(d).  37 C.F.R. §2.83; TMEP §§1208 et seq.  Therefore, upon entry of a response to this Office action, action on this case may be suspended pending final disposition of the earlier-filed application.

 

If applicant believes there is no potential conflict between this application and the earlier-filed application, then applicant may present arguments relevant to the issue in a response to this Office action.  The election not to submit arguments at this time in no way limits applicant’s right to address this issue at a later point.

AMENDED DESCRIPTION OF MARK REQUIRED

 

The description of the mark that has been made of record is not acceptable because it does not include the location of colors.  37 C.F.R. §2.37; see TMEP §§808 et seq. 

 

Applicant has submitted a color drawing and provided a color claim, but has not provided a mark description of the literal and design elements that specifies where all the colors appear in those elements.  Applications for marks depicted in color must include a description of all the literal and design elements in the mark that specifies where all the colors appear in those elements.  37 C.F.R. §§2.37, 2.52(b)(1); see TMEP §§807.07(a) et seq. 

 

If black, white and/or gray are not being claimed as a color feature of the mark, applicant must state that the colors black, white and/or gray represent background, outlining, shading and/or transparent areas and are not part of the mark.  TMEP §807.07(d).  Generic color names must be used to describe the colors in the mark, e.g., magenta, yellow, turquoise.  TMEP §807.07(a)(i)-(a)(ii).

 

Therefore, applicant must provide a description of the literal and design elements in the mark that specifies where all the colors appear in those elements.  The following description is suggested, if accurate:  “The mark consists of the following:  a stylized version of the term KNOWLEDGE in which the letters NOW and the power button design appear in red and the letters K and LEDGE appear in black. The "O" in "NOWLEDGE" consists of a fanciful representation of a power button.”  TMEP §807.07(a)(ii).
