EXPLANATION OF FILING

Applicant requests, under 37 C.F.R. §§2.146(a)(3) and (a)(5) to waive 37 C.F.R. §2.77, the Examining Attorney to examine and enter the below requested amendment (correction) during the period between the issuance of the Notice of Allowance and the filing of the Statement of Use.

 

Applicant as identified in the application (The Alpen House Limited, a Canadian (Ontario) corporation) filed the subject application on April 18, 2012.

 

Applicant’s counsel has recently learned that the Applicant underwent a name and domicile change on August 16, 2005 that has resulted in inaccuracies of how the Applicant was identified in the application as filed as well as all subsequent papers from and to the Office. The listing of the wrong name of the Applicant and its wrong domicile was an inadvertent mistake.

 

Pursuant to TMEP §1201.02(c), an Applicant incorrectly identified in the application may be corrected where “the owner of a mark legally changed its name before filing an application, but mistakenly lists its former name on the application.”

 

Accordingly, we kindly request that the official record be corrected in relation to the Applicant’s name and the Applicant’s incorporation as follows:
