When you and I corresponded over the summer on this, I believe you were going to issue an Examiner's Amendment containing the changes outlined below, but I don't think the Amendment was ever issued. Could you please issue the Amendment, or would you prefer that we file a Response to Office Action? Whichever you prefer.

Based on your explanation, I would be willing to accept your proposed identification amendment as follows: "Web-based computer software installed on an organization's servers and used to evaluate and prioritize an organization's capital and resource allocations and deployments" in International Class 9. Further, I can enter the following statements into the record, “The word FOLIO has no significance in the industry. As I mentioned in my voicemail message, I wanted to discuss some proposed changes to our identification of goods further to the Office Action you issued. Our software is actually installed on an organization's severs and then is accessed via the organization's intranet -- so it is web-based software, but we do not host it. Because of that, I think that Class 9 is appropriate, and that the identification read:
"Web-based computer software installed on an organization's servers and used to evaluate and prioritize an organization's capital and resource allocations and deployments"
We also wish to confirm that FOLIO has no significance in the industry.
If you could please call me at your convenience to discuss our proposed identification and classification, I would appreciate it.
