This Office action is in response to applicant’s communication filed on December 14, 2012 and the Amendment to Allege Use filed on December 20, 2012.
The amended identification is acceptable and the requirement is satisfied.
The Amendment to Allege Use is acceptable.
In addition, the examining attorney has determined that a similar mark of the applicant has recently registered. The following requirement is made.
CLAIM OF OWNERSHIP OF PRIOR REGISTRATION:
If applicant owns U.S. Registration No. 4330400, then applicant must submit for the application record a claim of ownership of this registration. See 37 C.F.R. §2.36; TMEP §812. See the attached copy of the registration. See TMEP §812.
