Identification of Goods/Classification

 

The identification of goods is indefinite and must be clarified because electric foot bath(s) indicates goods in Class 11, because some of the wraps and supports must clearly be identified for Class 10, and because inserts for footwear in Class 25 may also indicate goods in Class 10.  See TMEP §1402.01.  Applicant may adopt the following identification, if accurate: 

 

 

Class 10 -- Orthotic inserts for shoes; Electric foot spa massagers; Athletic ankle braces for medical use; Ankle supports and wraps for medical purposes; Wrist supports and wraps for medical purposes; Orthotic inserts and insoles for shoes; ankle supports, ankle wraps, wrist supports, wrist wraps, all for medical purposes; medical braces for wrists and ankles that incorporate electronic stimulators for nerves and muscles;

 

 

Class 11electric foot baths;

 

 

Class 25 -- Insoles; Shoes; Slippers; Sneakers; Footwear; Socks; A full line of footwear and inserts for footwear for primarily non-orthopedic purposes.

 

 

An applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
