I am the examining attorney assigned to Application Serial No. 85525868 for the mark GAME CHANGER. Your client is Thompson & Co. of Tampa, Inc. Thank you for the substitute specimen submitted on 10/18/2012. The mark is almost ready for publication; however, there is one change that needs to be made before I can proceed, and this change can be made over the phone:
Applicant’s current identification of goods in Class 34 is “Cigars.” However, the specimen shows that the mark is being used on packages of assorted cigars, rather than the cigars themselves. Applicant may adopt any of the following identification of goods, if accurate:
· “Packages of assorted cigars”
· “Cigar assortments”
· “Cigar samplers”
