This Office action is in response to applicant’s communication filed on 08/01/2012.

 

This application was refused on the ground that the applied-for mark, which consisted solely of a picture or rendering of the mark, did not show use of the mark in commerce in connection with the listed services.  Applicant has submitted a substitute specimen that is also unacceptable.  Consequently, the refusal of registration based on the failure to provide a specimen that shows the applied-for mark in use in commerce as a service mark is now made FINAL.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a), 2.64(a); TMEP §§904, 904.07(a).

 

SPECIMEN REFUSED – DOES NOT SHOW USE OF MARK WITH LISTED SERVICES

 

The specimen is not acceptable because it does not show the applied-for mark used in connection with any of the services specified in the application.  An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each class of services.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

 

In this case, the specimen appears to be a book with the title “The Rainforest.”  This specimen is unacceptable because use of the wording “The Rainforest” as the title of a book does show that applicant provides any of the services listed in the application under the RAINFOREST mark. 

 

Examples of specimens for services are signs, photographs, brochures, website printouts or advertisements that show the mark used in the actual sale or advertising of the services.  See TMEP §§1301.04 et seq.  In this case, an appropriate specimen of use might be a brochure that shows both the mark RAINFOREST and a clear description or listing of the services applicant provides.

 

PLEASE NOTE: Providing books that feature information in the fields of economics and business is not a service. Books are goods classified in International Class 16.  If applicant is providing goods, then an entirely new application would need to be filed (and a new processing fee paid) to seek trademark protection for those goods, because an applicant may amend an identification of services only to clarify or limit the services; adding to or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.  Amending from the services currently listed in the application to goods such as books would impermissibly broaden the identification.

 

Therefore, applicant must submit the following:

 

(1)  A substitute specimen showing the mark in use in commerce for the services specified in the application; and

 

(2)  The following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: The substitute specimen was in use in commerce at least as early as the filing date of the application.  37 C.F.R. §2.59(a); TMEP §904.05; see 37 C.F.R. §2.193(e)(1).  If submitting a substitute specimen requires an amendment to the dates of use, applicant must also verify the amended dates.  37 C.F.R. §2.71(c); TMEP §904.05.

 

If applicant cannot satisfy the above requirements, applicant may amend the application from a use in commerce basis under Section 1(a) to an intent to use basis under Section 1(b), for which no specimen is required.  See TMEP §806.03(c).  However, if applicant amends the basis to Section 1(b), registration will not be granted until applicant later amends the application back to use in commerce by filing an acceptable allegation of use with a proper specimen.  See 15 U.S.C. §1051(c), (d); 37 C.F.R. §§2.76, 2.88; TMEP §1103. 

 

To amend to Section 1(b), applicant must submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: Applicant has had a bona fide intention to use the mark in commerce on or in connection with the services listed in the application as of the filing date of the application.  37 C.F.R. §2.34(a)(2); TMEP §806.01(b); see 15 U.S.C. §1051(b); 37 C.F.R. §§2.35(b)(1), 2.193(e)(1).

 

ADVISORY: Because this application was filed using the TEAS Plus system, applicant must respond by using the Trademark Electronic Application System (TEAS) Response to Office Action Form to satisfy one of the following:

 

(1) Submit a verified substitute specimen as follows:  (a) answer “yes” to the TEAS response form wizard questions to “submit a new or substitute specimen” and “submit a signed declaration”; (b) on the next page, attach a jpg or pdf file of the substitute specimen; (c) check the box next to the statement “The substitute (or new, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application”; and (d) on the next page, applicant must personally sign or personally enter his/her electronic signature and date after the declaration at the end of the TEAS response form, and print or type the name of the signatory immediately below or adjacent to his/her signature or identify it elsewhere in the filing.; or 

 

(2) Amend the application to an intent to use filing basis under Trademark Act Section 1(b) as follows:  (a) answer “yes” to the TEAS response form wizard questions to “change filing basis” and for a “signed declaration,” respectively; (b) on the next page, uncheck the box for “Filing Basis Section 1(a);” (c) check the box for “Filing Basis Section 1(b);” and (d) on the next page, applicant must personally sign or personally enter his/her electronic signature and date after the declaration at the end of the TEAS response form, and print or type the name of the signatory immediately below or adjacent to his/her signature or identify it elsewhere in the filing.

Pending receipt of a proper response, registration is refused because the specimen does not show the applied-for mark in use in commerce as a service mark for the identified services.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).

 

This refusal is now made FINAL.

 

RESPONSE OPTIONS

 

If applicant does not respond within six months of the date of issuance of this final Office action, the application will be abandoned.  15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).  Applicant may respond to this final Office action by:

 

(1) Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or

 

(2) Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.

In certain rare circumstances, a petition to the Director may be filed pursuant to 37 C.F.R. §2.63(b)(2) to review a final Office action that is limited to procedural issues.  37 C.F.R. §2.64(a); TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining petitionable matters).  The petition fee is $100.  37 C.F.R. §2.6(a)(15).

 

TEAS PLUS APPLICANTS MUST SUBMIT DOCUMENTS ELECTRONICALLY OR SUBMIT FEE:  Applicants who filed their application online using the reduced-fee TEAS Plus application must continue to submit certain documents online using TEAS, including responses to Office actions.  See 37 C.F.R. §2.23(a)(1).  For a complete list of these documents, see TMEP §819.02(b).  In addition, such applicants must accept correspondence from the Office via e-mail throughout the examination process and must maintain a valid e-mail address.  37 C.F.R. §2.23(a)(2); TMEP §§819, 819.02(a).  TEAS Plus applicants who do not meet these requirements must submit an additional fee of $50 per international class of services.  37 C.F.R. §2.6(a)(1)(iv); TMEP §819.04.  In appropriate situations and where all issues can be resolved by amendment, responding by telephone to authorize an examiner’s amendment will not incur this additional fee.
