APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by Alberto Susterman on July 2, 2014, the trademark examining attorney has amended the application as indicated below. As discussed, the refusal under Trademark Act §2(d) has been withdrawn.
IDENTIFICATION OF GOODS AMENDED/CLASS 9 ONLY
The identification of goods in Class 9 is amended to read as follows. See TMEP §§1402.01, 1402.01(e).

COLOR CLAIM/DESCRIPTION OF THE MARK AMENDED
The color claim and color description of the mark have been amended to read as follows. See 37 C.F.R. §2.37; TMEP §§808 et seq.
The colors red, gold, and black are claimed as a feature of the mark.
The mark consists of the word SPIRIT in stylized red lettering having a gold outline. The design of a double infinity symbol in red appears behind the lower half of the word SPIRIT. The entire mark appears on a black rectangular carrier.
