Application serial no. 85493162 DELTA (Stylized and/or with Design, see http://tess2.gov.uspto.report/ImageAgent/ImageAgentProxy?getImage=85493162) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Applicant notes that the examiner has cited registration 3,256,714 as an obstacle to registration, namely due to the registration covering "pumps" and the listing of those goods in Applicant's application. As a result, Applicant has deleted and removed references to "pumps" in this Response and in an effort to remove this registration as an obstacle to Applicant's application.

With regard to Reg. number 3,315,229, Applicant notes the following: Comparing the designated goods of the Client’s mark with those of the cited mark “DELTA” bearing registration No. 3,315,229, most of the Client’s goods apply to the field of industry.  The designated goods of the cited mark should be different from the goods of the Client’s mark since most of them apply to the field of kitchen and household, for which general consumers are not the potential buyers.  They always are customized on the basis of special orders/requirements from different customers.  Therefore, their functions, relevant markets and sale channels of these designated goods are certainly dissimilar with each other.  Therefore, the present mark and the cited mark will not cause general consumers and relevant businesses to be confused or make a mistake. 

With regard to Serial number 79/081,690, Applicant notes: Comparing the designated goods of the Client’s mark with those of the cited mark “DELTA” bearing application No. 79/081,690, most of the Client’s goods apply to the commercial elevators for staff-transportation in the building.  The designated goods of the cited mark should be different from the goods of the Client’s mark since most of them apply to the outdoor cranes for freight, for which general consumers are not the potential buyers.  They always are customized on the basis of special orders/requirements from different customers. Therefore, their functions, relevant markets and sale channels of these designated goods are obviously dissimilar with each other.  Therefore, the present mark and the cited mark will not cause general consumers and relevant businesses to be confused or make a mistake.
