TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
ISSUE/MAILING DATE: 3/22/2012
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
However, the applicant should note the following informality.
Identification of Services
The identification of services is unacceptable as indefinite because it does not identify how the education services are provided and the nature and subject matter of the education and training services. The applicant may amend as follows:
“education services, namely, providing _______[indicate form of educational activity, e.g., classes, seminars, workshops] in the field of __________[indicate subject matter or field of educational activity].”
“training courses in strategic planning relating to advertising, promotion, marketing and business in the field of supply chain risk management and cyber security.”
Identifications of services can be amended only to clarify or limit the services; adding to or broadening the scope of the services is not permitted. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07. Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification. For assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of Acceptable Identifications of Goods and Services at http://tess2.gov.uspto.report/netahtml/tidm.html. See TMEP §1402.04.
PLEASE NOTE: The issue raised can be resolved by telephone or email. The applicant may telephone or email the trademark examining attorney (stephanie.ali@uspto.gov), instead of submitting a written response, to expedite the application by Examiner’s Amendment.
