ARGUMENT(S)

BBY Solutions, Inc., the referenced applicant (“Applicant”), hereby files this Response to the Office Action dated January 4, 2012.

 

In the Office Action, the Examiner has initially refused registration of Applicant’s mark ROCKETSYNC (“Applicant’s Mark”) based on U.S. Registration Nos. 1690753, 3271565, and 3282428 for the mark ROCKET (the “Cited Mark”).  The Examiner has also requested clarification and/or modification to the Applicant’s identification of goods.  Applicant appreciates the Examiner’s telephone conference of June 28, 2012, and for the reasons discussed with the Examiner, respectfully disagrees and requests that the refusal be withdrawn and the application be approved for publication. 

 

In this response, Applicant first responds to the Examiner’s likelihood of confusion refusal.  Applicant then responds to the Examiner’s request for further clarification of the identification of goods.

 

There Is No Likelihood Of Confusion Between Applicant’s Mark And The Cited Mark

 

Applicant respectfully submits that Applicant’s Mark is not likely to cause confusion with the Cited Mark because: (A) the differing channels of trade under which the goods are offered will avoid a likelihood of confusion, (B) Applicant has multiple ROCKET-formative registrations, including several with coverage for similar software, and consumers will likely associate Applicant’s Mark with that family of marks, (C) the coexistence of several ROCKET-formative marks on the register for goods similar to those offered under the Cited Mark alleviates a likelihood of confusion, and (D) Applicant’s Mark and the Cited Mark are not identical and have different commercial impressions.  Additionally, as shown in Section E in this Response, Applicant is willing to agree to remove the term "data" from the “Goods/Services” description in order to further specify Applicant’s goods.

 

A.        The Differing Channels Of Trade Prevent Confusion

 

Initially, Applicant submits that Applicant’s Mark is not likely to cause confusion with the Cited Mark because the conditions under which the goods are offered, including the differing channels of trade, will avoid a likelihood of confusion. 

 

It is proper when determining whether there is a likelihood of confusion to consider the similarity or dissimilarity of established, likely-to-continue channels of trade.  In re E.I. Du Pont de Nemours & Co., 177 U.S.P.Q., at 567.  Applicant’s computer software will be offered to end user consumers of consumer electronics products, while the Cited Mark is used with business-focused software, namely enterprise infrastructure software, that is targeted to businesses rather than individual consumers.  This difference in the goods themselves, as well as the marketplace in which they are offered, makes confusion between the goods offered under Applicant’s Mark and the Cited Mark unlikely.  In re Shoe Works, Inc., 6 U.S.P.Q.2d 1890 (T.T.A.B. 1988) (no likely confusion between PALM BAY for women’s shoes and PALM BAY for women’s shorts and pants where applicant stated its goods were sold solely through applicant’s retail stores).  Because the goods offered under the Cited Mark do not appear to be marketed to consumer electronics consumers, but are instead licensed by the registrant of the Cited Mark for business use, the goods offered under Applicant’s Mark and the services under the Cited Mark “are not … marketed in such a way that they would be encountered by the same persons in situations that would create the incorrect assumption that they originate from the same source.” TMEP § 1207.01(a)(i).  Accordingly, Applicant submits that Applicant’s Mark and the Cited Mark do not travel in the same channels of trade and it is not likely that consumers will believe that Applicant’s goods  and the registrant’s goods originate from the same source.

 

B.        Applicant Has Multiple Registrations For Its ROCKET-Formative Family Of Marks, Including Several Registrations With Coverage for Similar Software

           

Applicant further submits that, as shown by the following table, Applicant has established a family of ROCKET-formative marks and registrations for consumer electronics products. 

 

Applicant’s family of ROCKET-formative marks and registrations have co-existed both on the register and in the marketplace with the Cited Mark for several years.  Such co-existence, along with consumers’ prior exposure to Applicant’s ROCKET-formative family of marks, evidence that there is no likelihood of confusion between Applicant’s Mark and the Cited Mark.

The apparent widespread third-party use of ROCKET for business software products militates against a finding of confusing similarity.  In re Bed & Breakfast Registry, 791 F.2d 157, 159 (Fed. Cir. 1986). See also Armstrong Cork Co. v. World Carpets, Inc., 597 F.2d 496, 505 (5th Cir. 1979)(eighty-five carpet companies using the word “WORLD” in their businesses “militates against the finding of confusion”); Loctite Corp. v. Tubbs Cordage Co., 175 U.S.P.Q. 663, 665066 (T.T.A.B. 1972) (fifteen similar third-party registrations, some for hardware items, is evidence that can help narrow the scope of protection afforded a mark for specialty household and industrial goods); Pabst Brewing Co. v. Decatur Brewing Co., 284 F. 110, 112 (7th Cir. 1922) (over sixty different registrations for “BLUE RIBBON,” including registrations for whiskey and wine, “indicate that the Patent Office did not recognize a large measure of inclusiveness in the name.”). 

 

D.        Applicant’s Mark And The Cited Mark Are Not Identical And Have Different Commercial Impressions

 

In considering the question of likelihood of confusion under Section 2(d), the marks at issue must be considered in their entireties.  A mark should not be dissected into its component parts and each part then compared with corresponding parts of the conflicting marks to assess the potential likelihood of confusion.  3 J. Thomas McCarthy, McCarthy on Trademarks & Unfair Competition § 23:41, at 23-123–23-124 (4th ed. 2002) (hereinafter “McCarthy”).  “[I]n analyzing the similarities of sight, sound and meaning between two marks, a court must look to the overall impression created by the marks and not merely compare individual features.”  General Mills, Inc. v. Kellogg Co., 3 U.S.P.Q.2d 1442, 1445 (8th Cir. 1987) (holding that OATMEAL RAISIN CRISP for breakfast cereal was not confusingly similar to APPLE RAISIN CRISP for breakfast cereal).

 

When properly compared in their entireties, the distinction between Applicant’s Mark, ROCKETSYNC, and the Cited Mark, ROCKET, becomes apparent.  Applicant’s Mark combines two unrelated words into one fanciful word, in the same manner as Applicant’s related ROCKET-formative family of marks.  The Cited Mark is merely one word.

 

Because Applicant’s Mark and the Cited Mark are not the same in appearance, the overall commercial impressions of the respective marks are sufficiently different to avoid a likelihood of confusion.  See, e.g., Colgate-Palmolive Co. v. Carter-Wallace, Inc., 167 U.S.P.Q. 529, 530-31 (C.C.P.A. 1970) (holding that PEAK and PEAK PERIOD for personal care products were not confusingly similar because the addition of “PERIOD” causes the marks to have different commercial impressions); Electronic Reality Assoc., Inc. v. Kayser-Roth Corp., 216 U.S.P.Q. 61, 64 (T.T.A.B. 1982) (holding that ERA and GOLDEN ERA, both for clothing, were not confusingly similar because the marks had different commercial impressions); Interstate Brands Corp. v. Celestial Seasonings, Inc., 198 U.S.P.Q. 151, 152-53 (C.C.P.A. 1978) (finding no likelihood of confusion between ZINGERS for snack food and RED ZINGER for herbal tea). 

 

E.         Applicant is Willing to Delete “Data” From its Goods/Services Description

 

As discussed during the Examiner’s June 28, 2012 telephone conference with Applicant’s counsel, in the interest of further addressing the Examiner’s concern regarding the possibility of confusion arising, Applicant is willing to amend its Goods/Services description so that the description would read as follows:

 

Computer software for mobile phones, smart phones, computers, tablet computers, handheld electronic devices, televisions, home and automotive entertainment centers, namely, software for use in purchasing, downloading, transmitting, receiving, editing, playing, storing and organizing text, data, images, audio files, video files, applications, electronic games and other multimedia content via wired and wireless communications networks, including home and peer-to-peer computer networks, and via the Internet.

 

Applicant respectfully submits that, in light of the foregoing arguments, Applicant’s deletion of “data” from the Goods/Services description more than addresses any lingering concerns regarding the possibility of confusion arising.  Assuming that the Examiner agrees, Applicant would agree to an “Examiner’s Amendment” to the Application to make this change.

 

Applicant’s Identification of Goods

 

The Examiner requests further clarification relating to Applicant’s use of “playing” in the goods identification, stating that it is unclear what is being played.  The Examiner also requests that applicant indicate what “other multimedia content” refers to. 

 

In response, Applicant submits that it’s use of “playing” in the goods identification is to refer to the software’s ability to play the various types of files referenced in the identification (e.g., text, images, audio files, video files, applications, and electronic games).  Applicant respectfully submits that this explanation, along with Applicant’s proposed deletion of “data” to address the 2(d) refusal noted above, should be sufficient to address the Examiner’s inquiry.

 

With respect to “other multimedia content,” Applicant submits that it is referring to multimedia files that may be purchased, downloaded, transmitted, received, edited, played, stored or organized by the software.   In order to address any remaining concerns regarding this language, Applicant is willing to amend its Goods/Services description to delete the term “other,” so that the description would read as follows:

 

Computer software for mobile phones, smart phones, computers, tablet computers, handheld electronic devices, televisions, home and automotive entertainment centers, namely, software for use in purchasing, downloading, transmitting, receiving, editing, playing, storing and organizing text, data, images, audio files, video files, applications, electronic games and other multimedia content via wired and wireless communications networks, including home and peer-to-peer computer networks, and via the Internet.

 

Assuming that the Examiner agrees, Applicant would agree to an “Examiner’s Amendment” to the Application to make this change.

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

BBY Solutions, Inc., the referenced applicant (“Applicant”), hereby files this Response to the Office Action dated January 4, 2012.

 

In the Office Action, the Examiner has initially refused registration of Applicant’s mark ROCKETSYNC (“Applicant’s Mark”) based on U.S. Registration Nos. 1690753, 3271565, and 3282428 for the mark ROCKET (the “Cited Mark”).  The Examiner has also requested clarification and/or modification to the Applicant’s identification of goods.  Applicant appreciates the Examiner’s telephone conference of June 28, 2012, and for the reasons discussed with the Examiner, respectfully disagrees and requests that the refusal be withdrawn and the application be approved for publication. 

 

In this response, Applicant first responds to the Examiner’s likelihood of confusion refusal.  Applicant then responds to the Examiner’s request for further clarification of the identification of goods.

 

There Is No Likelihood Of Confusion Between Applicant’s Mark And The Cited Mark

 

Applicant respectfully submits that Applicant’s Mark is not likely to cause confusion with the Cited Mark because: (A) the differing channels of trade under which the goods are offered will avoid a likelihood of confusion, (B) Applicant has multiple ROCKET-formative registrations, including several with coverage for similar software, and consumers will likely associate Applicant’s Mark with that family of marks, (C) the coexistence of several ROCKET-formative marks on the register for goods similar to those offered under the Cited Mark alleviates a likelihood of confusion, and (D) Applicant’s Mark and the Cited Mark are not identical and have different commercial impressions.  Additionally, as shown in Section E in this Response, Applicant is willing to agree to remove the term "data" from the “Goods/Services” description in order to further specify Applicant’s goods.

 

A.        The Differing Channels Of Trade Prevent Confusion

 

Initially, Applicant submits that Applicant’s Mark is not likely to cause confusion with the Cited Mark because the conditions under which the goods are offered, including the differing channels of trade, will avoid a likelihood of confusion. 

 

It is proper when determining whether there is a likelihood of confusion to consider the similarity or dissimilarity of established, likely-to-continue channels of trade.  In re E.I. Du Pont de Nemours & Co., 177 U.S.P.Q., at 567.  Applicant’s computer software will be offered to end user consumers of consumer electronics products, while the Cited Mark is used with business-focused software, namely enterprise infrastructure software, that is targeted to businesses rather than individual consumers.  This difference in the goods themselves, as well as the marketplace in which they are offered, makes confusion between the goods offered under Applicant’s Mark and the Cited Mark unlikely.  In re Shoe Works, Inc., 6 U.S.P.Q.2d 1890 (T.T.A.B. 1988) (no likely confusion between PALM BAY for women’s shoes and PALM BAY for women’s shorts and pants where applicant stated its goods were sold solely through applicant’s retail stores).  Because the goods offered under the Cited Mark do not appear to be marketed to consumer electronics consumers, but are instead licensed by the registrant of the Cited Mark for business use, the goods offered under Applicant’s Mark and the services under the Cited Mark “are not … marketed in such a way that they would be encountered by the same persons in situations that would create the incorrect assumption that they originate from the same source.” TMEP § 1207.01(a)(i).  Accordingly, Applicant submits that Applicant’s Mark and the Cited Mark do not travel in the same channels of trade and it is not likely that consumers will believe that Applicant’s goods  and the registrant’s goods originate from the same source.

 

B.        Applicant Has Multiple Registrations For Its ROCKET-Formative Family Of Marks, Including Several Registrations With Coverage for Similar Software

           

Applicant further submits that, as shown by the following table, Applicant has established a family of ROCKET-formative marks and registrations for consumer electronics products. 

 

Applicant’s family of ROCKET-formative marks and registrations have co-existed both on the register and in the marketplace with the Cited Mark for several years.  Such co-existence, along with consumers’ prior exposure to Applicant’s ROCKET-formative family of marks, evidence that there is no likelihood of confusion between Applicant’s Mark and the Cited Mark.

Attached as Exhibit B are the TESS records for these marks.  This array of ROCKET marks for business software suggests that such marks can peacefully co-exist on the register and in the marketplace, and that Applicant’s non-identical mark for a software product targeted at purchasers of consumer electronics goods rather than businesses should be able to co-exist as well. 

 

The apparent widespread third-party use of ROCKET for business software products militates against a finding of confusing similarity.  In re Bed & Breakfast Registry, 791 F.2d 157, 159 (Fed. Cir. 1986). See also Armstrong Cork Co. v. World Carpets, Inc., 597 F.2d 496, 505 (5th Cir. 1979)(eighty-five carpet companies using the word “WORLD” in their businesses “militates against the finding of confusion”); Loctite Corp. v. Tubbs Cordage Co., 175 U.S.P.Q. 663, 665066 (T.T.A.B. 1972) (fifteen similar third-party registrations, some for hardware items, is evidence that can help narrow the scope of protection afforded a mark for specialty household and industrial goods); Pabst Brewing Co. v. Decatur Brewing Co., 284 F. 110, 112 (7th Cir. 1922) (over sixty different registrations for “BLUE RIBBON,” including registrations for whiskey and wine, “indicate that the Patent Office did not recognize a large measure of inclusiveness in the name.”). 

 

D.        Applicant’s Mark And The Cited Mark Are Not Identical And Have Different Commercial Impressions

 

In considering the question of likelihood of confusion under Section 2(d), the marks at issue must be considered in their entireties.  A mark should not be dissected into its component parts and each part then compared with corresponding parts of the conflicting marks to assess the potential likelihood of confusion.  3 J. Thomas McCarthy, McCarthy on Trademarks & Unfair Competition § 23:41, at 23-123–23-124 (4th ed. 2002) (hereinafter “McCarthy”).  “[I]n analyzing the similarities of sight, sound and meaning between two marks, a court must look to the overall impression created by the marks and not merely compare individual features.”  General Mills, Inc. v. Kellogg Co., 3 U.S.P.Q.2d 1442, 1445 (8th Cir. 1987) (holding that OATMEAL RAISIN CRISP for breakfast cereal was not confusingly similar to APPLE RAISIN CRISP for breakfast cereal).

 

When properly compared in their entireties, the distinction between Applicant’s Mark, ROCKETSYNC, and the Cited Mark, ROCKET, becomes apparent.  Applicant’s Mark combines two unrelated words into one fanciful word, in the same manner as Applicant’s related ROCKET-formative family of marks.  The Cited Mark is merely one word.

 

Because Applicant’s Mark and the Cited Mark are not the same in appearance, the overall commercial impressions of the respective marks are sufficiently different to avoid a likelihood of confusion.  See, e.g., Colgate-Palmolive Co. v. Carter-Wallace, Inc., 167 U.S.P.Q. 529, 530-31 (C.C.P.A. 1970) (holding that PEAK and PEAK PERIOD for personal care products were not confusingly similar because the addition of “PERIOD” causes the marks to have different commercial impressions); Electronic Reality Assoc., Inc. v. Kayser-Roth Corp., 216 U.S.P.Q. 61, 64 (T.T.A.B. 1982) (holding that ERA and GOLDEN ERA, both for clothing, were not confusingly similar because the marks had different commercial impressions); Interstate Brands Corp. v. Celestial Seasonings, Inc., 198 U.S.P.Q. 151, 152-53 (C.C.P.A. 1978) (finding no likelihood of confusion between ZINGERS for snack food and RED ZINGER for herbal tea). 

 

E.         Applicant is Willing to Delete “Data” From its Goods/Services Description

 

As discussed during the Examiner’s June 28, 2012 telephone conference with Applicant’s counsel, in the interest of further addressing the Examiner’s concern regarding the possibility of confusion arising, Applicant is willing to amend its Goods/Services description so that the description would read as follows:

 

Computer software for mobile phones, smart phones, computers, tablet computers, handheld electronic devices, televisions, home and automotive entertainment centers, namely, software for use in purchasing, downloading, transmitting, receiving, editing, playing, storing and organizing text, data, images, audio files, video files, applications, electronic games and other multimedia content via wired and wireless communications networks, including home and peer-to-peer computer networks, and via the Internet.

 

Applicant respectfully submits that, in light of the foregoing arguments, Applicant’s deletion of “data” from the Goods/Services description more than addresses any lingering concerns regarding the possibility of confusion arising.  Assuming that the Examiner agrees, Applicant would agree to an “Examiner’s Amendment” to the Application to make this change.

 

Applicant’s Identification of Goods

 

The Examiner requests further clarification relating to Applicant’s use of “playing” in the goods identification, stating that it is unclear what is being played.  The Examiner also requests that applicant indicate what “other multimedia content” refers to. 

 

In response, Applicant submits that it’s use of “playing” in the goods identification is to refer to the software’s ability to play the various types of files referenced in the identification (e.g., text, images, audio files, video files, applications, and electronic games).  Applicant respectfully submits that this explanation, along with Applicant’s proposed deletion of “data” to address the 2(d) refusal noted above, should be sufficient to address the Examiner’s inquiry.

 

With respect to “other multimedia content,” Applicant submits that it is referring to multimedia files that may be purchased, downloaded, transmitted, received, edited, played, stored or organized by the software.   In order to address any remaining concerns regarding this language, Applicant is willing to amend its Goods/Services description to delete the term “other,” so that the description would read as follows:

 

Computer software for mobile phones, smart phones, computers, tablet computers, handheld electronic devices, televisions, home and automotive entertainment centers, namely, software for use in purchasing, downloading, transmitting, receiving, editing, playing, storing and organizing text, data, images, audio files, video files, applications, electronic games and other multimedia content via wired and wireless communications networks, including home and peer-to-peer computer networks, and via the Internet.

 

Assuming that the Examiner agrees, Applicant would agree to an “Examiner’s Amendment” to the Application to make this change.

 

In view of the foregoing, Applicant respectfully submits that Applicant’s Mark is in condition for publication, however, the Examining Attorney is requested to contact the undersigned by telephone if a telephone conversation would expedite publication.  Accordingly, Applicant respectfully requests that the mark be published in the Official Gazette pursuant to 15 U.S.C. § 1062(a).
