SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

CLAIM OF OWNERSHIP OF REGISTRATIONS

 

If applicant is the owner of U.S. Registration No. 4094742, then applicant must submit a claim of ownership.  See 37 C.F.R. §2.36; TMEP §812.  The following standard format is suggested:

The identification of services is indefinite and must be clarified because it includes “promoting” in the services and therefore is possible misclassified and includes services in other classes. Class 41- Entertainment in the nature of competitions and special events in which structures are designed and built entirely of containers, including cans, boxes, bags, and bottles, filled with non-perishable food; arranging AND conducting and promoting competitions and special events in which structures are designed and built entirely of containers, including cans, boxes, bags, and bottles, filled with non-perishable food

 

  1. Class 43- Charitable services, namely, providing food TO NEEDY PERSONS, gathered through competitions and special events in which structures are designed and built entirely of containers, including cans, boxes, bags, and bottles, filled with non-perishable food and promoting the same

 

An applicant may amend an identification of services only to clarify or limit the services; adding to or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.

The filing fees for adding classes to an application are as follows:

(2)  $375 per class, when the fees are submitted with a paper response.
