DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Nathan Belzer on September 18, 2012, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

Color Claim and Description of the Mark

 

The color claim and description of the mark are amended as follows.  TMEP §807.07.

 

Color Claim: The colors red, white, green and gray are claimed as a feature of the mark.

 

Description of the Mark: The mark consists of the word "AFRiCAN" inside a rectangle with a curved top.  The rectangle is above the stylized word "PRIDE," which is above a curved line.  The color gray appears in the shading over the rectangle.   The color red appears in the rectangle and is intermixed with gray at the top and edges.  The color red also appears in the word "PRIDE" and in the curved line.  The color green appears in the dot over the "i" in "AFRiCAN" in the mark.  The color white appears in the word "AFRiCAN" in the mark, except for the dot over the letter "i."  The remainder of the white in the drawing represents background areas only and is not part of the mark.

 

In light of the foregoing, each previous refusal and/or requirement is withdrawn.  No response is necessary.  However, please do not hesitate to contact the undersigned with any questions.
