Mr. Sharinn,
I am the trademark examining attorney assigned to review this application. Before I can approve the mark for publication, there are two issues that must be resolved.
(1) Claim of Ownership of Prior Registrations. I need your consent to enter the following claim of prior registrations in the record:
Applicant is the owner of U.S. Registration Nos. 0551604 and 0588386.
(2) Identification of Goods. The wording “tobacco products” and “smokers’ articles” needs amendment to specify the particular types of goods. The term “lighters” needs an amendment to limit it to lighters for smokers (because there are other types of lighters in other classes). The following is a proposed amendment to address these issues:
Cigarettes; tobacco; tobacco products, namely, cigars and cigarettes; lighters for smokers; matches; smokers' articles, namely, ashtrays and cigarette rolling papers, in Class 34.
If you consent to these amendments, you can let me know by reply email or phone and I will enter them by Examiner’s Amendment. If you have any questions, please let me know. If I don’t hear back from you by the end of the day Wednesday (12/22), I will send you an Office action for the above issues. Thank you.
