TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
ISSUE/MAILING DATE: 5/4/2012
This Office action is in response to applicant’s communication filed on March 30, 2012.
INDEFINITE IDENTIFICATION OF SERVICES
In the initial office action, applicant was required to specify the type of information it provides to consumers as well as the type of information it collects from consumers. The current identification of services as revised in the Office action response dated March 30, 2012 does not adequately identify the type of information it provides and collects and is therefore indefinite and unacceptable. In addition, applicant must clarify the nature of comments its collects. The examining attorney notes that in the suggested identification of services below the term “customer comments” has been changed to “user comments” to avoid the implication of any services that would properly be classified in International Class 35.
For applicant’s convenience, its identification of services has been duplicated below with amendments appearing in a bold and italicized font. Applicant may adopt the following identification, if accurate:
Providing scientific information about products and services in the fields of human and environmental health technology; Research and development services, namely, collecting information and user comments of a scientific and technological nature on products and services in the fields of human and environmental health technology, in International Class 42.
For assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of Acceptable Identifications of Goods and Services at http://tess2.gov.uspto.report/netahtml/tidm.html. See TMEP §1402.04.
