Search for Conflicting Marks
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Requirement -- Identification of Goods
“glucose control reagent solutions for diagnostic or medical laboratory use,” in International Class 001;
“test strips for measuring blood glucose levels; glucose control reagent solutions for medical use,” in International Class 005;
“blood glucose meters; blood glucose diagnostic testing kits comprised of blood glucose meters, glucose test strips, and glucose control reagent solutions,” in International Class 010.
An applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq. Therefore, applicant must either (1) restrict the application to the number of classes covered by the fee(s) already paid, or (2) submit the fees for the additional class. The filing fees for adding classes to an application are as follows:
(1) $325 per class, when the fees are submitted with an electronic response filed online at http://www.gov.uspto.report/teas/index.html, via the Trademark Electronic Application System (TEAS); or
(2) $375 per class, when the fees are submitted with a paper response.
