NO CONFLICTING MARKS

 

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

 

DESCRIPTION OF THE MARK

 

The description of the mark contains some unnecessary information.  The following is suggested:

 

The mark consists of a green square as a background with the letter Q in white in the center of the box. The word BIG is written inside the letter Q. The letter B is green and the letters IG are in white. 

 

 

COLOR CLIAM

 

The following color claim is suggested:

 

            The colors green and white are claimed as a feature of the mark.

 

 

UNCLEAR ENTITY DESIGNATION

 

The name of an individual person appears in the section of the application intended for the trademark owner’s name, but the entity type is set forth as a limited liability company.  Applicant must clarify this inconsistency.  TMEP §803.03. 

 

If applicant is an individual, applicant should simply request that the entity be amended to “individual” and must indicate his/her country of citizenship for the record.  15 U.S.C. §1051(a)(2); 37 C.F.R. §2.32(a)(3)(i); TMEP §§803.02(a), 803.03(a), 803.04.  Alternatively, if applicant is a limited liability company, applicant must set forth its correct name and U.S. state or foreign country of incorporation or organization.  TMEP §§803.03(h), 803.04; see 37 C.F.R. §2.32(a)(2), (a)(3)(ii).

 

If, in response to the above request, applicant provides information indicating that it is not the owner of the mark, registration may be refused under Trademark Act Section 1, 15 U.S.C. §1051, because the application was void as filed.  Only the owner of a mark may apply to register the mark.  TMEP §§803.01, 803.06, 1201.02(b).

 

 

GOODS AND SERVICES INCIDENTAL TO DOING BUSINESS --ADVISORY

 

A written application must specify the particular goods and/or services on or in connection with which the applicant uses, or has a bona fide intention to use, the mark in commerce. 15 U.S.C. §§1051(a)(2) and 1051(b)(2); 37 C.F.R. §2.32(a)(6).  However, use of a mark on items that are merely incidental items used in conducting an ongoing business enterprise and are not “goods in trade.”  “Goods in trade” are items sold, transported or distributed in commerce for use by others, and provide a use or utility to others.  See 15 U.S.C. §1127; In re S’holders Data Corp., 495 F.2d 1360, 1361, 181 USPQ 722, 723 (C.C.P.A. 1974); TMEP §§1202.06 et seq. 

 

Therefore, applicant must amend the identification of goods to delete any items used merely to conduct its daily business. 

 

 

 

TEAS PLUS APPLICANTS MUST SUBMIT DOCUMENTS ELECTRONICALLY OR SUBMIT FEE:  Applicants who filed their application online using the reduced-fee TEAS Plus application must continue to submit certain documents online using TEAS, including responses to Office actions.  See 37 C.F.R. §2.23(a)(1).  For a complete list of these documents, see TMEP §819.02(b).  In addition, such applicants must accept correspondence from the Office via e-mail throughout the examination process and must maintain a valid e-mail address.  37 C.F.R. §2.23(a)(2); TMEP §§819, 819.02(a).  TEAS Plus applicants who do not meet these requirements must submit an additional fee of $50 per international class of goods and/or services.  37 C.F.R. §2.6(a)(1)(iv); TMEP §819.04.  In appropriate situations and where all issues can be resolved by amendment, responding by telephone to authorize an examiner’s amendment will not incur this additional fee.
