Section 2(d) Refusal – Likelihood of Confusion
In this case, the following factors are the most relevant: similarity of the marks, similarity of the goods and/or services, and similarity of trade channels of the goods and/or services. See In re Opus One, Inc., 60 USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc., 59 USPQ2d 1593 (TTAB 1999); In re Azteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq.
Comparison of the Marks
The applicant’s mark is RAGE and the registered mark is PURPLE RAGE. The marks are likely to create the same commercial impression in the minds of consumers, as they share the term RAGE.
Comparison of the Goods
The applicant is providing wine and the registrant is providing potable distilled spirits. The goods of both parties are likely to be marketed in the same manner and travel in the same channels of trade, which may lead consumers to believe that the goods emanate from a common source.
In light of the above, because the marks are similar and the goods of both parties are closely related, registration must be refused under Section 2(d) of the Trademark Act.
