Ms. Mays,

 

I am writing regarding the Notification of Deficiency regarding Fantasia Distribution’s applications for the marks Black Magic and White Lotus.  With regard to each of these applications, you entered a notice of deficiency concerning Fantasia’s petitions to revive abandoned applications, on the understanding that the USPTO had issued final Office Actions refusing registration.  It appears that there may be some confusion.  The November 19, 2012, actions were not final refusals, in substance, and in fact they are listed on the TDSR status site as “non-final” actions.  I would like to discuss this further with you before a further filing is due this week, so that we can clear this up if there has been a mistake.
