Prior to publication in the Official Gazette, a reviewer has queried certain goods in International Class 8, to wit, the identified “nail emery boards,” which is properly in International Class 3.  This application includes International Class 3, so the goods have been reclassified.  No prior approval or authorization from Applicant or Applicant’s attorney is required to reclassify these goods.  TMEP § 707.02. 

Please note that any future amendments to the goods in this application must be in accordance with Trademark Rule of Practice 2.71(a), 37 C.F.R. § 2.71(a) (2011).  See TMEP § 1402.07(e). 

RECLASSIFIED GOODS

The listed goods in International Classes 9, 18, 20, and 21 are unchanged.  The identified ““nail emery boards” is reclassified from International Class 8 to International Class 3, as follows: 

International Class 3

Beauty and cosmetic products, namely, sun-tanning preparations, cosmetic and eyebrow pencils, make-up removing preparations, dentifrice, depilatory milk for toilet purposes, make-up, make-up powders, make-up preparations, beauty masks, nail care preparations, nail varnishes, false-nails, cosmetic preparations for slimming purposes in the form of oils, lotions, creams and gels; oils for cosmetic purposes, pomades for cosmetic purposes, deodorants for personal use, cotton sticks and cotton wool for cosmetic purposes, cosmetic kits, namely, a small bag, box or case containing lip-stick, blush, mascara, cosmetic pencils and eye-shadow; cosmetic preparations for baths, cosmetic preparations for eyelashes, eyebrow cosmetics, decorative transfers for cosmetics purposes; firming, and rejuvenating, facial and body scrubs, foot lotions; cuticle products, namely, cuticle conditioners, creams and cuticle removing preparations; nail enamel and makeup remover, nail enamel top and base coats; pre moistened cosmetic wipes; nail emery boards.

Tweezers, eyelash curlers, nail files and clippers; eye brow trimmer, nail scoop hand implements for removing matter under fingernails and toenails, hand implements nail cleaner for use removing matter under fingernails and toenails, nail scissors, cuticle trimmer, pedicure hand and nail buffers, pedicure kits, namely, nail files, clippers, cuticle pushers, tweezers, scissors, foam toes separators, cuticle conditioners, and cuticle removing preparations, sold together as a set.
