The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

INFORMALITIES

 

1. IDENTIFICATION OF GOODS IS INDEFINITE AND REQUIRES CLARIFICATION:

The identification of goods needs clarification because applicant does not clearly specify the nature of the goods being provided.  See TMEP §§1402.01, 1402.03.

 

 

CLASS 11

The nature of the goods  is not clearly identified by the current wording in the identification.  The highlighted wording represents where  clarification is required.  The remaining portion of the identification is acceptable as provided.   The applicant may amend the identification to substitute the following wording, if accurate:

“Residential and commercial interior recessed lighting fixtures, architectural down lighting fixtures, residential down lighting fixtures, exit and emergency lighting fixtures, under cabinet lighting fixtures, electric track lighting units, rope lighting fixtures, step lighting fixtures, incandescent lighting housings fixtures, fluorescent lighting fixtures, low voltage lighting fixtures, decorative glass trims for lighting surface fixtures for new construction and remodel and retrofit construction.”

An applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.

 

 

Periodically the Office revises its international classification system and the policy regarding acceptable identifications of goods and services.  Identifications are examined in accordance with Rules of Practice and Office policies and procedures in effect on the application filing date.  37 C.F.R. §2.85(e)(1); TMEP §1402.14.  However, an applicant may voluntarily choose to follow policies and procedures adopted after the application was filed.  37 C.F.R. §2.85(e)(2).

 

Descriptions of goods and/or services found in earlier-filed applications and registrations are not necessarily considered acceptable identifications when a later-filed application is examined.  See TMEP §§702.03(a)(iv), 1402.14.

2.  GENERAL INQUIRY ON SIGNIFICANCE

Applicant must explain whether “IFIT” has any meaning or significance in the industry in which the goods and/or services are manufactured/provided, or if such wording is a “term of art” within applicant’s industry.  Applicant must also explain whether this wording identifies a geographic place.  See 37 C.F.R. §2.61(b); TMEP §814.

 

Further, applicant must provide additional information about this wording to enable proper examination of the application. 

 

Failure to respond to this request for information can be grounds for refusing registration.  See In re DTI P’ship LLP, 67 USPQ2d 1699, 1701 (TTAB 2003); TMEP §814.
