PRIORITY ACTION

 

DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

ISSUES APPLICANT MUST ADDRESS:  On June 23, 2011, the trademark examining attorney and Marina Cunningham discussed the issues below.  Applicant must timely respond to these issues.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.

IDENTIFICATION OF GOODS

 

The wording “bone void filler for medical and surgical use” in the identification of goods is indefinite and must be clarified because with regard to bone void fillers, the goods could be classified in Class 5 or 10 depending upon the material composition of the filler. More specifically, fillers that are made primarily from natural or biological ingredients are in Class 5 while bone fillers consisting of primarily synthetic and artificial ingredients are in Class 10.  See TMEP §1402.01. 

 

Applicant may adopt the following form of identification if accurate:

 

CLASS 5 - Bone cement for use in medical and surgical procedures; adhesive for bone fusion for medical and surgical use; and bone void fillers of natural or biological materials for medical and surgical use;

 

CLASS 10 - Bone void fillers of artificial or synthetic materials for medical and surgical use; Bone void fillers consisting primarily of synthetic materials and also incorporating biological materials.

 

An applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.

MULTICLASS APPLICATION REQUIREMENTS

 

For an application with more than one international class, called a “multiple-class application,” an applicant must meet all of the requirements below for those international classes based on use in commerce:

 

(1)        LIST GOODS AND/OR SERVICES BY INTERNATIONAL CLASS:  Applicant must list the goods and/or services by international class;

 

(2)        PROVIDE FEES FOR ALL INTERNATIONAL CLASSES:  Applicant must submit an application filing fee for each international class of goods and/or services not covered by the fee(s) already paid (confirm current fee information at http://www.uspto.gov, click on “View Fee Schedule” under the column titled “Trademarks”); and

 

(3)        SUBMIT REQUIRED STATEMENTS AND EVIDENCE:  For each international class of goods and/or services, applicant must also submit the following:

 

(a)        DATES OF USE:  Dates of first use of the mark anywhere and dates of first use of the mark in commerce, or a statement that the dates of use in the initial application apply to that class.  The dates of use, both anywhere and in commerce, must be at least as early as the filing date of the application.;

 

(b)        SPECIMEN:  One specimen showing the mark in use in commerce for each international class of goods and/or services.  Applicant must have used the specimen in commerce at least as early as the filing date of the application.  If a single specimen supports multiple international classes, applicant should indicate which classes the specimen supports.  Examples of specimens for goods are tags, labels, instruction manuals, containers, photographs that show the mark on the actual goods or packaging, or displays associated with the goods at their point of sale.  See TMEP §§904.03 et seq.  Examples of specimens for services are signs, photographs, brochures, website printouts, or advertisements that show the mark used in the actual sale or advertising of the services.  See TMEP §§1301.04 et seq.;

 

(c)        STATEMENT:  The following statement: The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.”; and

 

(d)        VERIFICATION:  Applicant must verify the statements in 3(a) and 3(c) (above) in an affidavit or signed declaration under 37 C.F.R. §2.20.  Verification is not required where (1) the dates of use for the added class are stated to be the same as the dates of use specified in the initial application, and (2) the original specimens are acceptable for the added class(es).

With respect to the specimen requirement in 3(b) above in which a specimen is required for each international class of goods and/or services, the specimen(s) of record is acceptable for International Class 5 only.  Applicant must submit additional specimens if different international classes are added to the application.  More specifically, a specimen would be required for the bone void fillers in Class 10 which consist of primarily artificial or synthetic ingredients.

 

Since applicant has paid a filing fee sufficient for one class of goods, applicant must limit this application to one of the above suggested classes (applicant’s choice) or pay an additional filing fee to include both classes.

If applicant does not want to add Class 10 to the application and limit this to Class5 only, applicant is encouraged to telephone the assigned trademark examining attorney to resolve the issues raised in this Office action.

If applicant does not respond to this Office action within the six-month period for response, the following goods in International Class 5 will be deleted from the application:  “bone void filler for medical and surgical use.”  The application will then proceed with the following goods in International Class 5 only:  Bone cement for use in medical and surgical procedures; adhesive for bone fusion for medical and surgical use.  See 37 C.F.R. §2.65(a); TMEP §718.02(a).
