PLEASE NOTE: Applicant is encouraged to telephone the assigned trademark attorney to resolve the issues raised in this Office action. The assigned trademark attorney has reviewed the referenced application and has determined the following:
The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02. In order to pursue registration, however, the applicant must respond to the following requirements.
Requirement for Submission of Statement Claiming Ownership of Prior Registrations
Applicant is the owner of U.S. Registration Nos. 3668455, 3886244 and 3921220.
Requirement for Amendment to Color Claim and Color Location Statements
While there is a color claim statement of record, it does not include all of the colors appearing in the drawing page for the proposed mark, thus the statement is inaccurate and must be corrected. Applications for marks depicted in color must include a complete list of all the colors claimed as a feature of the mark. 37 C.F.R. §2.52(b)(1); see TMEP §§807.07(a) et seq.
If black, white and/or gray are not being claimed as a color feature of the mark, applicant must state that the colors black, white and/or gray represent background, outlining, shading and/or transparent areas and are not part of the mark. TMEP §807.07(d). Generic color names must be used to identify the colors in the mark, e.g., magenta, yellow, turquoise. TMEP §807.07(a)(i)-(a)(ii).
Therefore, applicant must provide the required color claim. The following is suggested, if accurate: “The colors Black, Yellow, Blue, Pink and Orange are claimed as a feature of the mark.” TMEP §807.07(a)(i).
The description of the mark is accurate but incomplete because it does not describe all the significant aspects of the applied-for mark. Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies literal elements as well as any design elements. See 37 C.F.R. §2.37; TMEP §§808 et seq.
Therefore, applicant must provide a more complete description of the applied-for mark. The following is suggested:
“The mark consists of the stylized wording “LIVINGSOCIAL” in black lettering with the design of four overlapping circles forming the dot above the letter “I” in the term “SOCIAL.” The design is comprised of four overlapping circles of different sizes with the smallest circle in orange on the bottom which is overlapped by a larger pink circle above it, which is overlapped by a larger blue circle above it which is overlapped by a larger yellow circle to the side of the blue and pink circles.”
