SURNAME REFUSAL

 

Registration is refused because the applied-for mark, INGRAM, is primarily merely a surname.  Trademark Act Section 2(e)(4), 15 U.S.C. §1052(e)(4); see TMEP §1211.  The primary significance of the mark to the purchasing public determines whether a term is primarily merely a surname.  In re Etablissements Darty et Fils, 759 F.2d 15, 17-18, 225 USPQ 652, 653 (Fed. Cir. 1985); In re Kahan & Weisz Jewelry Mfg. Corp., 508 F.2d 831, 832, 184 USPQ 421, 422 (C.C.P.A. 1975); see TMEP §§1211, 1211.01.

 

Please see the evidence below from LexisNexis, a division of Reed Elsevier Inc. All Rights Reserved., establishing the surname significance of the surname INGRAM.  This evidence shows the applied-for mark appearing 22617 times as a surname in a nationwide telephone directory of names.

 

The following five factors are used to determine whether a mark is primarily merelya surname:

 

(1)        Whether the surname is rare; (which, in this case, it is not rare)

 

(2)        Whether anyone connected with applicant uses the term as a surname;

 

(3)        Whether the term has any recognized meaning other than as a surname;

 

(4)        Whether the term has the structure and pronunciation of a surname; and

 

(5)        Whether the term is sufficiently stylized to remove its primary significance from that of a surname.  (the applied-for mark is in standard characters)

 

In re Benthin Mgmt. GmbH, 37 USPQ2d 1332, 1333-34 (TTAB 1995); TMEP §1211.01.

 

 

A mark deemed primarily merely a surname may be registered on the Principal Register under Trademark Act Section 2(f) by satisfying one of the following:

 

            (1)  Submit a claim of ownership of one or more prior registrations on the Principal Register for a mark that is the same as the mark in the application and for the same or related goods and/or services.  37 C.F.R. §2.41(b); TMEP §§1212, 1212.04.  The following wording is suggested:  “The mark has become distinctive under Section 2(f) of the goods or services as evidenced by ownership of U.S. Registration No(s). ____________  on the Principal Register for the same mark for the same or related goods and/or services.”  TMEP §1212.04(e).;

 

            (2)  Submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20:  “The mark has become distinctive of the goods through applicant’s substantially exclusive and continuous use in commerce for at least the five years immediately before the date of this statement.”  37 C.F.R. §2.41(b); TMEP §1212.05(d); see 37 C.F.R. §2.193(e)(1).; or

 

            (3)  Submit actual evidence of acquired distinctiveness.  37 C.F.R. §2.41(a); TMEP §1212.06.  Such evidence may include the following:  examples of advertising and promotional materials that specifically promote the applied-for mark as a trademark and/or service mark in the United States; dollar figures for advertising devoted to such promotion; dealer and consumer statements of recognition of the applied-for mark as a trademark and/or service mark; and any other evidence that establishes recognition of the applied-for mark as a source-identifier for the goods and/or services.  See In re Ideal Indus., Inc., 508 F.2d 1336, 184 USPQ 487 (C.C.P.A. 1975); In re Instant Transactions Corp. of Am., 201 USPQ 957 (TTAB 1979); TMEP §§1212.06 et seq.

 

Trademark Act Section 2(f), 15 U.S.C. §1052(f); see 37 C.F.R. §2.41; TMEP §§1211, 1212.

 

If applicant cannot satisfy one of the above, applicant can amend the application to seek registration on the Supplemental Register.  Trademark Act Section 23, 15 U.S.C. §1091; see 37 C.F.R. §§2.47, 2.75(a).

 

Although the examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.  If the applicant chooses to respond to the refusal to register, the applicant must also respond to the following.

 

IDENTIFICATION OF GOODS

 

Applicant has submitted the following identification of goods for International Class 007

The wording “metalworking machines and tools” in the identification of goods is unacceptable as indefinite.  Applicant must specify the type(s) of metalworking machines.

For example, if accurate, the applicant may amend this wording to:

  • metalworking machines, namely, _________________ [e.g., cutting machines, boring machines lathes and metalworking machine tools

 

The wording “chemical processing machines and apparatus;” in the identification of goods is unacceptable as indefinite.  Applicant must specify the common commercial name of the goods.  For example, if accurate, the applicant may amend this wording to:

  • chemical processing machines and apparatus, namely, _________________ [e.g., emulsifying machines,  extracting machines, granulating machines]

 

The wording “textile machines and apparatus;” in the identification of goods is unacceptable as indefinite. Applicant must specify the common commercial name of the goods.  

For example, if accurate, the applicant may amend this wording to:

  • textile machines and apparatus, namely, ________________ [e.g., machines for dyeing textiles, printing machines for textile, textile bonding machines, textile scotching machines]

 

The wording “food processing and beverage processing machines and apparatus;” in the identification of goods is unacceptable as indefinite.  Applicant must specify the common commercial name of the goods.   For example, if accurate, the applicant may amend this wording to:

  • food processing and beverage processing machines and apparatus, namely, ___________ [e.g., electric grinder, electric mixers

 

 

The wording “lumbering, woodworking, or veneer or plywood making machines and apparatus;” in the identification of goods is unacceptable as indefinite.  Applicant must specify the common commercial name of the goods.  For example, if accurate, the applicant may amend this wording to:

  • lumbering, woodworking, or veneer or plywood making machines and apparatus, namely, ____________ [e.g.,  lumbering band saws, circular saw for woodworking, veneer and plywood finishing machines]

 

The wording “pulp making, papermaking or paper-working machines and apparatus;” and “printing or bookbinding machines and apparatus; packaging or wrapping machines and apparatus;” in the identification of goods is unacceptable as indefinite. The use of the term “or” in this instance in indefinite.  An application must specify, in an explicit manner, the particular goods or services on or in connection with which the applicant uses, or has a bona fide intention to use, the mark in commerce.  See 15 U.S.C. §1051(a)(2), (b)(2); 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Generally, the terminology “and/or” and “or” is not sufficiently explicit language in identifications because it is not clear whether applicant is using the mark, or intends to use the mark, on all the identified goods or services.  See TMEP §1402.03(a).     For example, if accurate, the applicant may amend this wording to:

  • pulp making, papermaking and paper-working machines and apparatus; printing and bookbinding machines and apparatus; packaging machines and apparatus; wrapping machines and apparatus;

 

 

The wording “plastic processing machines and apparatus;” in the identification of goods is unacceptable as indefinite.  Applicant must provide more specificity as to the nature of the goods.  For example, if accurate, the applicant may amend this wording to:

  • plastic processing machines and apparatus, namely, ____________ [e.g., extrusion machines for plastic,  injection plastic molding machines, machines for plastics working]

 

The wording “and systems” in the phrase “semiconductor manufacturing machines and systems;” in the  identification of goods is unacceptable as indefinite. 

For example, if accurate, the applicant may amend this wording to:

  • semiconductor manufacturing machines and systems comprised of ______________ [specify the major components of the semiconductor manufacturing systems]

 

 

The wording “machines and apparatus for manufacturing rubber goods; ” in the identification of goods is unacceptable as indefinite. 

For example, if accurate, the applicant may amend this wording to:

  • machines and apparatus for manufacturing rubber goods, namely, _____________________ [e.g.,  rubber forming machines

 

 

The wording “non-electric prime movers, not for land vehicles (other than water mills and wind mills);” in the identification of goods is unacceptable as indefinite. 

For example, if accurate, the applicant may amend this wording to:

  • Non-electric prime movers, not for land vehicles, namely, engines other than for land vehicles, water mills and wind mills;

 

 

The wording “AC motors and DC motors (not including those for land vehicles but including parts for any AC motors and DC motors);” in the identification of goods is unacceptable as indefinite. 

For example, if accurate, the applicant may amend this wording to:

  • Electric AC motors and their parts and DC motors and their parts, not including those for land vehicles

 

 

Applicant has submitted the following identification of goods for International Class 009:

measuring or testing devices and instruments; power distribution or control devices and apparatus; rotary converters; phase modifiers; batteries and cells; telecommunication devices and apparatus; electronic machines, apparatus and their parts

 

 

The wording “measuring or testing devices and instruments” in the identification of goods is unacceptable as indefinite.  Applicant must specify the common commercial name for each measuring and testing device and instrument.

 

The wording “power distribution or control devices and apparatus;” in the identification of goods is unacceptable as indefinite.  Applicant must specify the common commercial name for each power distribution and control device and apparatus. 

 

The wording “telecommunication devices and apparatus;” in the identification of goods is unacceptable as indefinite. Applicant must specify the common commercial name(s) of the telecommunication devices and apparatus.   For example, if accurate, the applicant may amend this wording to:

  • telecommunication devices and apparatus, namely, __________________ [e.g., telephones]

 

 

The wording “electronic machines, apparatus and their parts” in the identification of goods is unacceptable as indefinite. Applicant must specify the common commercial name(s) of the electronic machines, electronic apparatus and their parts.

 

 

 

Filing Basis

 

The application specifies both an intent to use basis under Trademark Act Section 1(b) and reliance on a foreign registration(s) under Section 44(e).  See 15 U.S.C. §§1051(b), 1126(e); 37 C.F.R. §2.34(a)(2)-(3).  However, the foreign registration alone may serve as a basis for obtaining a U.S. registration.  See 37 C.F.R. §2.34(a)(3); TMEP §806.01(d).  If applicant wants to rely on the foreign registration under Section 44(e) as the sole basis, applicant can request deletion of the Section 1(b) basis.  See 37 C.F.R. §2.35(b)(1); TMEP §806.04.

 

Alternatively, inasmuch as applicant has not yet submitted the foreign registration or otherwise perfected the Section 44(e) basis, applicant can amend the application to rely solely on the Section 1 basis and request deletion of the Section 44(e) basis.

 

Unless applicant indicates otherwise, this Office will presume that applicant is relying on both Sections 1(b) and 44(e).  Thus, although the mark may be approved for publication, it will not register until an acceptable allegation of use has been filed for the goods and/or services based on Section 1(b).

 

 

Search    TMEP §704.02   The trademark examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).
