U. S. Trademark Application Serial Number 85/217933
The petition to the Director filed on October 14, 2015 for the above-identified trademark application is GRANTED pursuant to 37 C.F.R. §2.146(a)(3).
The application will be returned to the assigned examining attorney to consider the request to amend the basis from Section 1(b) to Section 44(e) of the Trademark Act. If the amendment is accepted the application will be republished. If the amendment is refused, applicant will be notified of the refusal.
Since the time for filing a statement of use has expired and no further extension requests can be filed, the notice of allowance will be cancelled and the Section 1(b) basis will be deleted. The application will then be forwarded to the examining attorney to examine the amendment to substitute Section 44(e) as the basis for registration. The Section 1(b) basis cannot be reinserted. See TMEP §806.03(j). If the amendment is accepted the application will be republished. If the amendment is refused, applicant will be notified of the refusal.
Please contact the assigned examining attorney directly to check on the status of the amendment to the basis.
