Search Results

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

Identification of Goods

 

     Class 003

 

The applicant identified its goods as “Pet shampoo, cleansers, lotions and skin and coat care products.”

The wording in the identification of goods is indefinite and must be clarified to indicate that the goods are non-medicated in nature.  See TMEP §1402.01.  Please note, medicated preparations are properly classified in Class 005.

 

     Class 005

 

The applicant identified its goods as “Dietary supplements for pets and nutritional supplements for arthritic pets; veterinary preparations for use as a calming aid; dietary stool deodorizer.”

 

The wording “veterinary preparations for use as a calming aid” in the identification of goods is indefinite and must be clarified to indicate the type of animal the preparation is used on.  See TMEP §1402.01.

 

The wording “dietary stool deodorizer” in the identification of goods is indefinite and must be clarified to further indicate the nature of the goods.  See TMEP §1402.01.

 

The applicant may adopt the following if accurate:

 

Class 003:        NON-MEDICATED GROOMING PREPARATIONS, NAMELY pet shampoo, cleansers, lotions and skin and coat care products

 

Class 005:        Dietary supplements for pets and nutritional supplements for arthritic pets; veterinary preparations FOR PETS for use as a calming aid; VETERINARY PREPARATION, NAMELY dietary stool deodorizer       FOR USE IN PETS

 

Identifications of goods can be amended only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

 

Proper classification of goods is a purely administrative matter within the sole discretion of the United States Patent and Trademark Office.  In re Tee-Pak, Inc., 164 USPQ 88, 89 (TTAB 1969).

Disclaimer

 

Applicant must disclaim the descriptive wording “VET” apart from the mark as shown because it merely describes a characteristic of the goods.  See 15 U.S.C. §1056(a); TMEP §§1213, 1213.03(a).  The term VET is an abbreviation for the word VETERINARIAN (see attached).   Applicant’s goods are various types of veterinary preparations and are only available for purchase through a veterinarian or VET (see specimen of record).

 

The computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.  TMEP §1213.08(a)(i).  The following is the standard format used by the Office:

 

No claim is made to the exclusive right to use “VET” apart from the mark as shown.

A disclaimer does not physically remove the disclaimed matter from the mark, but rather is a written statement that applicant does not claim exclusive rights to the disclaimed wording and/or design separate and apart from the mark as shown in the drawing.  TMEP §§1213, 1213.10.
