Application serial no. 85137825 has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Examiner has initially refused registration pending a revision to the recitation of goods and submission of a substitute specimen.  Applicant amends the goods recited in the application as noted herein and submits a substitute specimen of use.

CLASSIFICATION AND LISTING OF GOODS/SERVICES
Applicant proposes to amend the following class of goods/services in the application:

Section 1051(a), as amended. The mark was first used at least as early as 03/10/1980 and first used in commerce at least as early as 03/10/1980, and is now in use in such commerce.

Applicant hereby submits a new specimen for Class 011. The specimen(s) submitted consists of digital photograph of product packaging bearing the mark.

Applicant first used the mark in connection with "liquid fuel burning space heaters" in commerce at least as early as March 10, 1980. Applicant first used the mark in connection with "gas heaters for residential and commercial use" and "electric heaters for residential and commercial use" anywhere at least as early as 2009. Applicant first used the mark in connection with "gas heaters for residential and commercial use" and "electric heaters for residential and commercial use" in commerce at least as early as 2009.
