Remaining Issue--Classification of Goods
“Active chemical ingredient for use in the manufacture of pharmaceutical preparations for skin care” is in Class 1. Please note that the applicant’s argument that the Class 5 Manual ID, "dry ingredients for making a saline solution" justifies classification of an active chemical ingredient in Class 5 is incorrect. The dry ingredients in that particular Class 5 ID are in the nature of a dry pharmaceutical preparation that one mixes with liquids in order to create a liquid pharmaceutical preparation for sinus and nasal irrigation.
