THIS IS A FINAL ACTION.
This Office action is in response to applicant’s communication filed on July 22, 2011. Applicant’s substitute specimen has been considered, but the specimen refusal is maintained and made final for the reasons detailed below.
Drawing Refusal Made FINAL:
The requirement for an acceptable specimen that agrees with the mark in the application, and the refusal pending receipt of the same, is now made FINAL for the reasons detailed below. See37 C.F.R. §2.64(a).
Mark Differs on Drawing and Specimen – FINAL Refusal:
The mark on the specimen disagrees with the mark on the drawing. In its response, applicant has presented an additional copy of the same specimen that was submitted when it filed its SOU. Applicant describes the specimen as a “Cover page of product user guide.” The specimen still shows the mark as “ONSTOR EVERON SOFTWARE,” whereas the mark is “EVERON.” Thus, the substitute specimen still does not show use of the mark in the application for the goods in the application.
An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each class of goods and/or services. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). The mark on the drawing must be a substantially exact representation of the mark on the specimen. 37 C.F.R. §2.51(a); TMEP §807.12(a); see 37 C.F.R. §2.72(a)(1). In addition, the drawing of the mark can be amended only if the amendment does not materially alter the mark as originally filed. 37 C.F.R. §2.72(a)(2); see TMEP §§807.12(a), 807.14 et seq. As noted previously, although the word “SOFTWARE” is generic in the context of the goods and can thus be ignored, the word “ONSTOR” is part of the phrase/trademark on the specimen and changes the impression of the mark because it is a novel, non-descriptive/non-generic word in the context of the goods.
Therefore, applicant must submit one of the following:
(1) A new drawing of the mark that agrees with the mark on the specimen but does not materially alter the original mark. See 37 C.F.R. §2.72(a)(2); TMEP §§807.12(a), 807.14 et seq. Amending the drawing to agree with the specimen would not be considered a material alteration of the mark in this case.; or
(2) A substitute specimen showing use in commerce of the mark on the drawing, and the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: “The substitute specimen was in use in commerce at least as early as the filing date of the application.” See 37 C.F.R. §§2.59(a), 2.193(e)(1); TMEP §§807.12(a), 904.05. If submitting a specimen requires an amendment to the dates of use, applicant must also verify the amended dates. 37 C.F.R. §2.71(c); TMEP §904.05.
If applicant cannot satisfy one of the above requirements, applicant may amend the application from a use in commerce basis under Trademark Act Section 1(a) to an intent to use basis under Section 1(b), for which no specimen is required. See TMEP §806.03(c). However, if applicant amends the basis to Section 1(b), registration will not be granted until applicant later amends the application back to use in commerce by filing an acceptable allegation of use with a proper specimen. See 15 U.S.C. §1051(c)-(d); 37 C.F.R. §§2.76, 2.88; TMEP §1103.
To amend to Section 1(b), applicant must submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: “Applicant has had a bona fide intention to use the mark in commerce on or in connection with the goods and/or services listed in the application as of the filing date of the application.” 37 C.F.R. §2.34(a)(2); TMEP §806.01(b); see 15 U.S.C. §1051(b); 37 C.F.R. §§2.35(b)(1), 2.193(e)(1).
Pending receipt of a proper response, registration is refused because the specimen does not show the applied-for mark in use in commerce as a trademark and/or service mark. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
This refusal is now made FINAL.
Declaration for a Substitute Specimen – TEAS:
If applicant experiences difficulty in submitting the required substitute specimen, supporting statement and/or declaration, please e-mail TEAS@uspto.gov for technical assistance regarding the TEAS response form.
Electronically Submitted Specimen:
If applicant files a response online using the Trademark Electronic Application System (TEAS), the substitute specimen must be submitted in jpg or pdf format. 37 C.F.R. §2.56(d)(4); TMEP §904.02(a). The Office recommends that all black-and-white and color jpg images be scanned at no less than 300 dots per inch and no more than 350 dots per inch, with a length and width of no less than 250 pixels and no more than 944 pixels.
When validating an electronic submission through TEAS, applicant should ensure that the substitute specimen is attached to the submission. If the substitute specimen cannot be viewed from the “Validation Page,” the specimen failed to attach properly and will not be included with the response.
Responding to FINAL Refusal to Register:
If applicant does not respond within six months of the date of issuance of this final Office action, the application will be abandoned. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a). Applicant may respond to this final Office action by:
(1) Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or
(2) Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.

In certain rare circumstances, a petition to the Director may be filed pursuant to 37 C.F.R. §2.63(b)(2) to review a final Office action that is limited to procedural issues. 37 C.F.R. §2.64(a); TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining petitionable matters). The petition fee is $100. 37 C.F.R. §2.6(a)(15).
