The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Although no similar registered or pending mark has been found that would bar registration, applicant must satisfy the following requirements.

Classification and Identification of Goods

 

The wording “cartridges of carbon dioxide absorbent for use in a breathing device” in the identification of goods is indefinite and must be clarified because it could include goods in other classes.  See TMEP §1402.01.  Applicant must amend the identification to specify the common commercial name of the goods.  If there is no common commercial name, applicant must describe the product and its intended uses.  See id.

 

The examining attorney’s suggestions are incorporated in the identification referenced below.

 

Applicant may adopt the following identification, if accurate:

 

Cartridges of carbon dioxide absorbent, namely, (specify what comprises the “absorbent” by common commercial name) for use in a breathing device.  International Class 1. 

 

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

Claimed Prior Registrations Not Pertinent

 

Applicant’s claim of ownership of U.S. Registration Nos. 1437819 and 1607468 will not be printed on any registration that may issue from this application because the marks are different.  Only prior registrations of the same or similar marks are considered related registrations for purposes of an ownership claim.  See 37 C.F.R. §2.36; TMEP §812.
