Identification of Goods and Services – Amendment Required
The wording “Downloadable software applications that enable interaction and interface between motor land vehicles and mobile devices; downloadable software in the nature of vehicle operating system software; apparatus and instruments for accumulating and storing electricity; apparatus, instruments and cables for electricity; wires (electric)” in the identification of goods for International Class 009 is indefinite and must be clarified because more information is needed as to the nature of the software, apparatus, instruments, cables, and wires. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.
The wording “scooters; motor land vehicles and parts, fittings and accessories thereof falling in this class” in the identification of goods for International Class 012 is indefinite and must be clarified because more information is needed as to the specific type of scooters and the nature of the parts, fittings, and accessories. Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended. Foreign Entity Designation Not Listed in TMEP Appendix D - Clarification Required
The application identifies applicant as a “Body Incorporate,” which is not acceptable as an entity designation in the United States because there is no clear U.S. equivalent legal entity and the entity designation does not appear in Appendix D of the Trademark Manual of Examining Procedure. See TMEP §803.03(i). Applicant must indicate the U.S. equivalent of its legal entity or provide a description of the nature of the foreign entity.
