The Office has reassigned this application to the undersigned trademark examining attorney.

 

Pursuant to TMEP §§705.01, 707.03, and 713.02, applicant is advised of the following status of the application.  In a previous Office Action dated September 8, 2020, the following issues were outstanding:

 

  1. Identification amendment required
  2. Entity clarification required
  3. Color claim and mark description clarification required
  4. Appointment of U.S. Counsel required

 

In light of applicant’s change of correspondence address form filed on January 13, 2021, applicant’s response filed on January 15, 2021, and the amendment detailed below, the examining attorney has determined the following:    

 

  1. The requirement to amend the identification is hereby satisfied.
  2. The applicant clarified for the record that it is a corporation.  Therefore, the requirement to clarify the entity type is hereby satisfied.
  3. Applicant has provided a substitute black-and-white drawing.  Therefore, the requirement to clarify the color claim and mark description is satisfied.
  4. Applicant appointed U.S. counsel, and therefore, this requirement is hereby satisfied.

 

 

Application has been amended as shown below.  As agreed to by Nicole Rackiewicz, attorney for applicant, on February 5, 2021, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

IDENTIFICATION OF GOODS AMENDED

 

The identification of goods and services is amended to read as follows: 

 

Class 8: “Hand-operated sharpening instruments; hand-operated hand tools, namely, hand drills, hack saws, cutting tools; hand-operated gardening tools, namely, trowels, weeding forks, spades, hoes; depilation appliances, electric and non-electric; laser hair removal apparatus, other than for medical purposes; razors, electric or non-electric; hair clippers for personal use, electric and non-electric; hand instruments, namely, shearers; tweezers; scissors”

 

Class 10: “Sterilized medical instruments for cutting tissue, percutaneous tracheostomy; medical lamps, namely, medical examination lamps, medical operating lamps; surgical lamps; dental apparatus and instruments, namely, prophy angles, oral irrigators, crown and bridge removers; filters for ultraviolet rays, for medical purposes; ultraviolet ray lamps for medical purposes; gloves for medical purposes; feeding bottles; orthopedic articles, namely, walkers, braces, shoes; suture materials”

 

Class 11:  “Arc lamps; ultraviolet halogen metal vapor lamp; germicidal lamps for purifying air; ultraviolet ray lamps, not for medical purposes; electric air deodorizing apparatus for refrigerators; air purifying apparatus and machines; germicidal lamps for purifying air, namely, germicidal burners; radiators for heating; bath installations; disinfectant apparatus for banknotes, medical purposes, industrial purposes; sterilizer units for medical use”

SUBSTITUTE DRAWING SUBMITTED

 

Applicant submitted an acceptable substitute drawing that replaces the original drawing. TMEP § 807.15.
