I have reviewed your response in the above-referenced application.

 

With regard to the claim of ownership of the prior registrations, the claim of ownership must be supported by a signed declaration. Because the response does not include a signed declaration, I cannot withdraw the refusal based on ownership of the registrations. If you would like to re-submit the claim of ownership of the four registrations with the declaration, you may do so using the Voluntary Amendment Form rather than the response to office form since the response form will not allow you to file a response after the deadline for responding to the Office action has passed.

 

Additionally, there are a few items in the identification of goods and services that must be clarified. If you file the voluntary amendment form, you can either include these amendments in the form submission or authorize me to enter them via examiner’s amendment once you have filed the voluntary amendment form.

 

In Class 3, you must clarify the nature of the hair preparations because they encompass medicated hair preparations in Class 5.

 

In Class 9, you must clarify the nature of the protective visors.

 

In Class 18, the wording “body bags” is unacceptable because it identifies goods in Class 22. You must also clarify the nature of pouch bags and indicate that the cosmetic and toilet bags are sold empty, if accurate.

 

In Class 24, you must clarify the wording “flannels” because in its plural form, it is unclear whether the wording identifies flannel fabric or goods made from flannel.

 

In Class 28, you must clarify the type of sporting articles in the wording “bags and cases specially adapted for sporting articles,” the type of  apparatus and equipment for playing tennis, the balls sports the protective padding and gloves are used for and the nature of the supports for ball sports.

 

The following wording is suggested, if accurate:

The identification of goods and services in Classes 25 and 35 is acceptable as amended. The remaining issues in the Office action have been resolved.

 

I understand that there are quite a few suggested changes and that the applicant is located in Italy. If you would prefer that I issue a final Office action for the section 2(d) refusal and requirement for clarification of the identification of goods, I would be happy to do so.  I will need to take action on this application by next Wednesday March 10.
