ARGUMENT(S)
Applicant seeks registration of the mark KNAUF on the Principal Register. In the pending Office Action, the Examining Attorney raised objections under Sections 2(d) and 2(e)(4) and raised various objections to the identification of goods and services. Applicant respectfully requests reconsideration in view of the following amendments, comments and observations. As to the objections to the ID, by this submission applicant has amended the ID in the manner suggested by the Examining Attorney. Applicant has also amended the application to (1) clarify the nature of the entity and (2) add a description of the mark. As to the Section 2(d) rejection, applicant would respectfully point out that all of the cited registrations are owned by "related" companies (within the meaning provided in Section 45 of the Lanham Act) that are under common ownership and control. More specifically, applicant would show that: applicant (Knauf Gips KG) and the owners of record of the cited registrations (Knauf Fiber Glass GmbH, Knauf Insulation GmbH and Knauf Insulation Holding GmbH) are all sister companies that are under the common ownership and control of their common parent company, Gebr. Knauf KG (a German company); that such parent company has corporate power and authority to control the manner and use of the KNAUF name and mark by the aforementioned entities as well as the quality of the goods and/or services provided by such entities under and in association with the KNAUF name and mark; and that such parent company does, in fact, exercise control over the manner and use of the KNAUF name and mark by the aforementioned entities as well as the quality of the goods and/or services provided by such entities under and in association with the KNAUF name and mark. In view of these facts, applicant respectfully requests withdrawal of the Section 2(d) rejection. As to the Section 2(e)(4) rejection, applicant has amended the application to claim acquired distinctiveness. To that end, applicant would point out that four other registrations already exist on the Principal Register for marks comprising KNAUF (albeit held in the names of related entities as mentioned above), that applicant is part of a large multinational family of companies, that the KNAUF name has been in use in the United States for over 40 years (based on the use dates specified in Reg. No. 1888480), that the KNAUF name and mark are well-known in the United States and elsewhere and associated with applicant's family of companies, and that, as a result of the prior registrations coupled with the long use in the U.S., the KNAUF name has acquired distinctiveness as an indication of origin, separate and apart from a surname. More specifically, as stated on the company's website (http://www.knauf.com/en/about-knauf/about-us/company-profile/), the Knauf group of companies "had comparably humble beginnings. Specifically, the family company was established in 1932, when brothers Alfons and Karl Knauf secured the mining rights to gypsum deposits in the Schengen community (Obermosel) in Germany. Courage, determination, and business savvy were the reasons that only a year later Knauf established its first gypsum factory in Perl (Moselle) ? laying the foundation for what would later be the Knauf Group. Today, Knauf is one of the world's leading manufacturers of modern insulation materials, drylining systems, plasters and accessories, thermal insulation composite systems, paints, floor screed, floor systems, and construction equipment and tools. With 220 production facilities and sales organisations in over 80 countries, 28,000 employees worldwide, and sales of 7.2 billion Euro (in 2018), the Knauf Group is without doubt one of the big players on the market ? in Europe, the USA, South America, Russia, Asia, Africa, and Australia." As to the specific questions posed by the Examining Attorney, applicant provides the following responses in the order in which the questions are presented in the Office Action: (1) Knauf is not particularly rare; (2) certain shareholders and employees associated with the Knauf group of companies have Knauf as their surname; (3) as detailed above, the term Knauf has also come to be recognized as a company name and distinctive mark associated with the Knauf family of companies, separate and apart from its meaning as merely a surname; (4) the term does have the structure and pronunciation of a surname; and (5) applicant believes the stylized features of the applied-for mark distinguish the mark from a surname. In view of the foregoing, applicant respectfully requests withdrawal of the Section 2(e) (4) rejection. Application serial no. 79237600 KNAUF (Stylized and/or with Design, see http://uspto.report/TM/79237600/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Applicant seeks registration of the mark KNAUF on the Principal Register. In the pending Office Action, the Examining Attorney raised objections under Sections 2(d) and 2(e)(4) and raised various objections to the identification of goods and services. Applicant respectfully requests reconsideration in view of the following amendments, comments and observations. As to the objections to the ID, by this submission applicant has amended the ID in the manner suggested by the Examining Attorney. Applicant has also amended the application to (1) clarify the nature of the entity and (2) add a description of the mark. As to the Section 2(d) rejection, applicant would respectfully point out that all of the cited registrations are owned by "related" companies (within the meaning provided in Section 45 of the Lanham Act) that are under common ownership and control. More specifically, applicant would show that: applicant (Knauf Gips KG) and the owners of record of the cited registrations (Knauf Fiber Glass GmbH, Knauf Insulation GmbH and Knauf Insulation Holding GmbH) are all sister companies that are under the common ownership and control of their common parent company, Gebr. Knauf KG (a German company); that such parent company has corporate power and authority to control the manner and use of the KNAUF name and mark by the aforementioned entities as well as the quality of the goods and/or services provided by such entities under and in association with the KNAUF name and mark; and that such parent company does, in fact, exercise control over the manner and use of the KNAUF name and mark by the aforementioned entities as well as the quality of the goods and/or services provided by such entities under and in association with the KNAUF name and mark. In view of these facts, applicant respectfully requests withdrawal of the Section 2(d) rejection. As to the Section 2(e)(4) rejection, applicant has amended the application to claim acquired distinctiveness. To that end, applicant would point out that four other registrations already exist on the Principal Register for marks comprising KNAUF (albeit held in the names of related entities as mentioned above), that applicant is part of a large multinational family of companies, that the KNAUF name has been in use in the United States for over 40 years (based on the use dates specified in Reg. No. 1888480), that the KNAUF name and mark are well-known in the United States and elsewhere and associated with applicant's family of companies, and that, as a result of the prior registrations coupled with the long use in the U.S., the KNAUF name has acquired distinctiveness as an indication of origin, separate and apart from a surname. More specifically, as stated on the company's website (http://www.knauf.com/en/about-knauf/about-us/company-profile/), the Knauf group of companies "had comparably humble beginnings. Specifically, the family company was established in 1932, when brothers Alfons and Karl Knauf secured the mining rights to gypsum deposits in the Schengen community (Obermosel) in Germany. Courage, determination, and business savvy were the reasons that only a year later Knauf established its first gypsum factory in Perl (Moselle) ? laying the foundation for what would later be the Knauf Group. Today, Knauf is one of the world's leading manufacturers of modern insulation materials, drylining systems, plasters and accessories, thermal insulation composite systems, paints, floor screed, floor systems, and construction equipment and tools. With 220 production facilities and sales organisations in over 80 countries, 28,000 employees worldwide, and sales of 7.2 billion Euro (in 2018), the Knauf Group is without doubt one of the big players on the market ? in Europe, the USA, South America, Russia, Asia, Africa, and Australia." As to the specific questions posed by the Examining Attorney, applicant provides the following responses in the order in which the questions are presented in the Office Action: (1) Knauf is not particularly rare; (2) certain shareholders and employees associated with the Knauf group of companies have Knauf as their surname; (3) as detailed above, the term Knauf has also come to be recognized as a company name and distinctive mark associated with the Knauf family of companies, separate and apart from its meaning as merely a surname; (4) the term does have the structure and pronunciation of a surname; and (5) applicant believes the stylized features of the applied-for mark distinguish the mark from a surname. In view of the foregoing, applicant respectfully requests withdrawal of the Section 2(e) (4) rejection.
