This is a PROVISIONAL FULL REFUSAL of the request for extension of protection of the mark in the above-referenced U.S. application.  See 15 U.S.C. §1141h(c).  See below in this notification (hereafter “Office action”) for details regarding the provisional full refusal.

 

The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

 

 

SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

REFUSAL – NO BONA FIDE INTENT TO LAWFULLY USE IN COMMERCE –

MARIJUANA-RELATED GOODS/SERVICES – BASED ON EVIDENCE

 

Registration is refused because applicant does not have a bona fide intent to lawfully use the applied-for mark in commerce.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; see TMEP §907. 

 

To qualify for federal trademark/service mark registration, the use of a mark in commerce must be lawful.  Gray v. Daffy Dan’s Bargaintown, 823 F.2d 522, 526, 3 USPQ2d 1306, 1308 (Fed. Cir. 1987) (stating that “[a] valid application cannot be filed at all for registration of a mark without ‘lawful use in commerce’”); TMEP §907; see In re Stellar Int’l, Inc., 159 USPQ 48, 50-51 (TTAB 1968); Coahoma Chemical Co., Inc. v. Smith, 113 USPQ 413 (Com’r Pat. & Trademarks 1957) (concluding that “use of a mark in connection with unlawful shipments in interstate commerce is not use of a mark in commerce which the [Office] may recognize.”).  Thus, the goods and/or services to which the mark is applied must comply with all applicable federal laws.  See In re Brown, 119 USPQ2d 1350, 1351 (TTAB 2016) (citing In re Midwest Tennis & Track Co., 29 USPQ2d 1386, 1386 n.2 (TTAB 1993) (noting that “[i]t is settled that the Trademark Act’s requirement of ‘use in commerce,’ means a ‘lawful use in commerce’”)); In re Pepcom Indus., Inc., 192 USPQ 400, 401 (TTAB 1976); TMEP §907. 

 

Here, the evidence of record indicates that the items or activities to which the proposed mark will be applied are unlawful under the federal Controlled Substances Act (CSA), 21 U.S.C. §§801-971. 

 

The CSA prohibits, among other things, manufacturing, distributing, dispensing, or possessing certain controlled substances, including marijuana and marijuana extracts.  21 U.S.C. §§812, 841(a)(1), 844(a).  Marijuana includes “all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin” (subject to certain exceptions). 21 U.S.C. §802(16).  Marijuana extract is a subset of the materials that the CSA defines as marijuana.  Specifically, marijuana extract is “an extract containing one or more cannabinoids that has been derived from any plant of the genus Cannabis, other than the separated resin (whether crude or purified) obtained from the plant.” 21 C.F.R. §1308.11(d)(58).  Cannabinoids “include delta-9-tetrahydrocannabinol, cannabidiol, cannabinol, and cannabichromene.”  21 CFR §862.3870(a). 

 

The United States Drug Enforcement Agency (DEA)’s has issued guidance (attached hereto from DEADIVERSION.USDOJ.GOV) explains that “cannabinoids, such as . . . cannabidiols (CBD), are found in the parts of the cannabis plant that fall within the CSA definition of marijuana, such as the flowering tops, resin, and leaves.” Clarification (citing H. Mölleken & H. Husmann, Cannabinoids in Seed Extracts of Cannabis Sativa Cultivars, 4 J. Int’l Hemp Ass’n 73 (1997)). “[C]annabinoids are not found in the parts of the cannabis plant that are excluded from the CSA definition of marijuana, except for trace amounts (typically, only parts per million) that may be found where small quantities of resin adhere to the surface of seeds and mature stalk.”  Id. (citing Mölleken & Husmann, supra; S.A. Ross et al., GC-MS Analysis of the Total Delta9-THC Content of Both Drug- and Fiber-Type Cannabis Seeds, 24 J. Analytical Toxicology 715 (2000)). 

 

In this case, the application identifies the following goods and/or services:  smoker’s articles.  Applicant’s broadly worded identification of “smoker’s articles” must be presumed to include all types of smoker’s articles including cigarettes and liquid extracts used in electronic smoking devices.  The attached excerpt from applicant’s website plainly indicates that applicant’s identified goods/services include items and/or activities that are prohibited by the CSA, namely, that it is selling cigarettes containing a blend of tobacco and high CBD content cannabis.  The photographs contained on the website show that the cannabis used in the goods contain mixture of leaves, stems and buds.  All of these portions of the plant fall within the CSA’s definition of marijuana regardless of whether or not applicant claims it is using industrial hemp.  Both plants are from the genus Cannabis sativa L. 

 

Accordingly, because the identified goods and/or services consist of or include items or activities that are prohibited under the Controlled Substances Act, applicant cannot have a bona fide intent to lawfully use the applied-for mark in commerce in connection with the goods and/or services.  See In re JJ206, LLC, 120 USPQ2d 1568, 1569 (TTAB 2016)(“where the identified goods are illegal under the federal Controlled Substances Act (CSA), the applicant cannot use its mark in lawful commerce, and ‘it is a legal impossibility’ for the applicant to have the requisite bona fide intent to use the mark.”); TMEP §907.

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in support of registration.  However, if applicant responds to the refusal(s), applicant must also respond to the requirement(s) set forth below.

 

IDENTIFICATION OF GOODS

 

The wording “smoker’s articles” in the identification of goods is indefinite and must be clarified because it fails to identify specific goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant must list each and every single smoker’s article by its common name, e.g., smoking pipes, electronic cigarettes, electronic cigarette liquids comprised of flavorings other than essential oils, ashtrays, cigars, cigarettes, cigarette rolling papers.

 

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably narrowed.  See 37 C.F.R. §2.71(a); TMEP §§1402.06, 1904.02(c)(iv).  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found or encompassed by those in the original application or as acceptably narrowed.  See TMEP §1402.06(a)-(b).  The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).  Additionally, for applications filed under Trademark Act Section 66(a), the scope of the identification for purposes of permissible amendments is limited by the international class assigned by the International Bureau of the World Intellectual Property Organization (International Bureau); and the classification of goods and/or services may not be changed from that assigned by the International Bureau.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b).  Further, in a multiple-class Section 66(a) application, classes may not be added or goods and/or services transferred from one existing class to another.  37 C.F.R. §2.85(d); TMEP §1401.03(d).

 

Applicant may adopt the following form of identification, if accurate:  (Note that proposed changes have been placed in bold type.  Some items require applicant to include more complete information.  These have been designated with brackets {  } and bold italics.  The information in the brackets is suggested as an example for applicant to follow and should not be merely “cut and pasted.”):  

 

CLASS 34 – Tobacco; smoker’s articles, namely, {list each and every such item by its common name in Class 34 only e.g., smoking pipes, electronic cigarettes, electronic cigarette liquids comprised of flavorings other than essential oils, ashtrays, cigars, cigarettes, cigarette rolling papers, matches, lighters for smokers, humidors, hookahs}.

TRANSLATION STATEMENT REQUIRED

 

Applicant must submit an English translation of all foreign wording in the mark.  37 C.F.R. §§2.32(a)(9), 2.61(b); see TMEP §809.  In the present case, the wording “Heimat” requires translation.

 

The following translation statement is suggested: 

 

The English translation of the word “Heimat” in the mark is “Home or “Home Country.”

WHO IS PERMITTED TO RESPOND TO THIS PROVISIONAL FULL REFUSAL:  Any response to this provisional refusal must be personally signed by an individual applicant, all joint applicants, or someone with legal authority to bind a juristic applicant (e.g., a corporate officer or general partner).  37 C.F.R. §§2.62(b), 2.193(e)(2)(ii); TMEP §712.01.  If applicant hires a qualified U.S. attorney to respond on his or her behalf, then the attorney must sign the response.  37 C.F.R. §§2.193(e)(2)(i), 11.18(a); TMEP §§611.03(b), 712.01.  Qualified U.S. attorneys include those in good standing with a bar of the highest court of any U.S. state, the District of Columbia, Puerto Rico, and other U.S. commonwealths or U.S. territories.  See 37 C.F.R. §§2.17(a), 2.62(b), 11.1, 11.14(a); TMEP §§602, 712.01.  Additionally, for all responses, the proper signatory must personally sign the document or personally enter his or her electronic signature on the electronic filing.  See 37 C.F.R. §2.193(a); TMEP §§611.01(b), 611.02.  The name of the signatory must also be printed or typed immediately below or adjacent to the signature, or identified elsewhere in the filing.  37 C.F.R. §2.193(d); TMEP §611.01(b).

 

In general, foreign attorneys are not permitted to represent applicants before the USPTO (e.g., file written communications, authorize an amendment to an application, or submit legal arguments in response to a requirement or refusal).  See 37 C.F.R. §11.14(c), (e); TMEP §§602.03-.03(b), 608.01.
