TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

This Final Office action is in response to applicant’s communication filed on August 28, 2018.
In a previous Office action dated June 14, 2018, the trademark examining attorney required applicant to satisfy the following requirements: amend the identification of goods and clarify applicant’s entity type.
The trademark examining attorney maintains and now makes FINAL the requirements in the summary of issues below. See 37 C.F.R. §2.63(b); TMEP §714.04.
SUMMARY OF ISSUES MADE FINAL that applicant must address:
· IDENTIFICATION OF GOODS
The wording “Food additives for industrial purposes for the use in the food industry, as far as contained in this class” in the identification of goods is indefinite and must be clarified because it does not state the nature or purpose of the food additives within the scope of International Class 1. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Additionally, the extraneous wording “as far as contained in this class” should be deleted. Applicant may substitute the following wording, if accurate:
“Chemical additives for the use in the manufacture of food; enzymes for industrial purposes, in particular for foodstuff industries”
The undersigned trademark examining attorney notes that in applicant’s August 28, 2018 Response to Office Action, applicant included this suggested identification in the “Description of Evidence File” field, but did not amend the identification itself. Thus, it is unclear from the face of the response whether applicant intended the suggested language to replace the original language of the identification. As such, the suggested language cannot be accepted as an amendment.
