STRICT DEADLINE TO RESPOND TO THIS NOTIFICATION:  TO AVOID ABANDONMENT OF THE REQUEST FOR EXTENSION OF PROTECTION OF THE INTERNATIONAL REGISTRATION, THE USPTO MUST RECEIVE A COMPLETE RESPONSE TO THIS PROVISIONAL FULL REFUSAL NOTIFICATION WITHIN 6 MONTHS OF THE “DATE ON WHICH THE NOTIFICATION WAS SENT TO WIPO (MAILING DATE)” LOCATED ON THE WIPO COVER LETTER ACCOMPANYING THIS NOTIFICATION.

 

In addition to the Mailing Date appearing on the WIPO cover letter, a holder (hereafter “applicant”) may confirm this Mailing Date using the USPTO’s Trademark Status and Document Retrieval (TSDR) system at http://tsdr.gov.uspto.report/.  To do so, enter the U.S. application serial number for this application and then select “Documents.”  The Mailing Date used to calculate the response deadline for this provisional full refusal is the “Create/Mail Date” of the “IB-1rst Refusal Note.”

 

This is a PROVISIONAL FULL REFUSAL of the request for extension of protection of the mark in the above-referenced U.S. application.  See 15 U.S.C. §1141h(c).  See below in this notification (hereafter “Office action”) for details regarding the provisional full refusal.

 

The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

Search Results of Office’s Database of Registered and Pending Marks

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

SUMMARY OF ISSUES that applicant must address:

 

  • Mark description
  • Identification of goods and services

 

Description of Mark Required

The applied-for mark is not in standard characters and applicant did not provide a description of the mark with the initial application.  Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies literal elements as well as any design elements.  See 37 C.F.R. §2.37; TMEP §§808.01, 808.02, 808.03(b). 

 

Therefore, applicant must provide a description of the applied-for mark.  The following is suggested:

 

The mark consists of a shield with two grotesque figures and a curved line above the wording “SAFEZONE” in stylized font.

 

Identification of Goods and/or Services Must be Amended

The wording “application software” must be amended. An identification for software must specify the purpose or function of the software.  See TMEP §1402.03(d).  If the software is field-specific, the identification must also specify the field of use.  Id.  Clarification of the purpose, function, or field of use of the software is necessary for the USPTO to properly examine the application and make appropriate decisions concerning possible conflicts between the applicant’s mark and other marks.  See In re N.A.D. Inc., 57 USPQ2d 1872, 1874 (TTAB 2000).

 

In addition, applicant must specify the common commercial name of the “apparatus, equipment and devices for use in conjunction with the foregoing types of application software”. The identification of goods is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the goods.  If there is no common commercial or generic name, applicant must describe the product and intended consumer as well as its main purpose and intended uses. 

 

Lastly, applicant must amend the identification of services. Specifically, applicant must clarify the purpose of the software identified in the wording “Hosting of software as a service (SaaS); software as a service (SaaS); online provision of web-based software; provision of online non-downloadable software (application service provider)” and clarify the nature of the “support services for software”. The identification of services is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the services.  If the services have no common commercial or generic name, applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s). 

 

For the applicant’s convenience, the trademark examining attorney suggests an amendment of applicant’s identification of goods and/or services that complies with the above-mentioned clarification requirements. Applicant may adopt the following identification, if accurate:

 

International Class 9: “Application software for [specify items, e.g., mobile phones], namely, software for [specify the function of the programs, e.g., use in database management]; application software designed to facilitate the communication or intercommunication between electronic devices via any wired or wireless communication channel; application software designed to facilitate real-time communications between electronic devices; application software designed to facilitate point to point communications and transmissions between electronic devices; application software designed to facilitate communications and transmissions between communication networks, including digital or telecommunications networks of any type or size; application software designed to allow communications systems to manage, monitor and communicate security threats or emergencies; application software designed to facilitate the geo-location, surveillance, monitoring or tracking of other persons or objects; application software designed for use with a digital device by persons to enable their geo-location, surveillance, monitoring or tracking by security personnel; application software designed to facilitate the operation of personal security or personal safety devices; application software designed for use in conjunction with personal security or personal safety devices; application software designed to promote the personal security or personal safety of the user; application software designed to facilitate emergency communications; application software designed to assist with navigation or global-positioning; application software designed to facilitate the sending and receiving of distress calls or signals via an electronic device having telecommunications or Internet capabilities; application software designed to enable an electronic device to be used for emergency signalling, including general alarm capabilities; application software with interactive capabilities to facilitate the real-time transmission of text, images, video, audio and other information via electronic devices; application software designed to facilitate the relaying or transmitting of text, video or audio information from an electronic device to other electronic devices; application software designed to facilitate the recording, transmission or storage of audio or video via electronic devices; application software for the location mapping, target mapping and the real-time tracking of persons; application software for determining directions, positions or routes via electronic devices; application software to enable the rapid transmission or download of data between electronic devices; application software for security systems and devices; application software for alarm systems and devices; application software for emergency systems and devices; application software for personal security or personal safety devices; application software for surveillance and tracking devices; application software for global-positioning and navigational devices; application software for communications or telecommunications systems and devices; application software of the foregoing types, all of which can be downloaded from or distributed via the Internet; apparatus, equipment and devices for use in conjunction with the foregoing types of application software, namely, [specify common commercial name of goods]

 

International Class 42: “Software as a service (SAAS) services, namely, hosting software for use by others for use {specify the function of the programs, e.g., for use in database management, for use as a spreadsheet, for word processing, etc. and, if software is content- or field-specific, the field of use}; software as a service (SaaS) services featuring software for {specify the function of the programs, e.g., for use in database management, for service desk management, for accounting, etc., and, if software is content- or field-specific, the content or field of use}; providing non-downloadable software for {specify the function of the programs, e.g., for use in database management, for use as a spreadsheet, for word processing, etc. and, if software is content - or field-specific, the field of use}; application service provider (ASP) featuring software for use {specify the function of the programs, e.g., for use in database management, for use as a spreadsheet, for word processing, etc. and, if software is content - or field-specific, the field of use} ; installation and maintenance of computer software; technical support services, namely, troubleshooting of computer software problems; modifying of computer software; updating of computer software; upgrading of computer software; advisory and design services relating to computer software used in electronic devices to facilitate the security of buildings, locations, objects and persons; advisory and design services relating to computer software used in electronic devices to facilitate the geo-location, surveillance, monitoring or tracking of persons or objects; advisory and design services relating to computer software used in electronic devices to facilitate the transmission of distress calls or signals; advisory and design services relating to computer software used in communications systems or computer networks to manage, monitor and communicate security threats or emergencies; advisory and design services relating to computer software used in communications systems or computer networks to locate emergencies or security breaches in a location; advisory and design services relating to computer software used in personal security systems and devices; advisory and design services relating to computer software used in alarm systems and devices; advisory and design services relating to computer software used in personal security or personal safety devices; advisory and design services relating to computer software used in surveillance and tracking devices; advisory and design services relating to computer software used in global-positioning and navigational devices; advisory and design services relating to computer software used to operate communications or telecommunications systems and devices; advisory and design services relating to computer software used to operate electronic devices which transmit emergency communications; advisory and design services relating to computer software used to operate electronic devices which exchange information; advisory and design services relating to computer software used to operate electronic devices for the real-time transmission of text, images, audio or video information; advisory and design services relating to computer software used to operate electronic devices for communication or intercommunication via any wired or wireless communication channel”

 

An applicant may amend an identification of goods and/or services only to clarify or limit the goods and/or services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §1904.02(c)(iv).  In an application filed under Trademark Act Section 66(a), the scope of the identification for purposes of permissible amendments is limited by the international class assigned by the International Bureau of the World Intellectual Property Organization (International Bureau).  37 C.F.R. §2.85(f); TMEP §§1402.07(a), 1904.02(c).  If an applicant amends the identification to a class other than that assigned by the International Bureau, the amendment will not be accepted because it will exceed the scope and those goods and/or services will no longer have a basis for registration under U.S. law.  TMEP §§1402.01(c), 1904.02(c).

 

In addition, in a Section 66(a) application, an applicant may not change the classification of goods and/or services from that assigned by the International Bureau in the corresponding international registration.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1402.01(c).  Further, in a multiple-class Section 66(a) application, an applicant may not transfer goods and/or services from one existing international class to another.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1402.01(c).

Response Guidelines

For this application to proceed toward registration, applicant must explicitly address each refusal and/or requirement raised in this Office action.  If the action includes a refusal, applicant may provide arguments and/or evidence as to why the refusal should be withdrawn and the mark should register.  Applicant may also have other options for responding to a refusal and should consider such options carefully.  To respond to requirements and certain refusal response options, applicant should set forth in writing the required changes or statements. 

 

If applicant does not respond to this Office action within six months of the issue/mailing date, or responds by expressly abandoning the application, the application process will end, the trademark will fail to register, and the application fee will not be refunded.  See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a), 2.68(a), 2.209(a); TMEP §§405.04, 718.01, 718.02.  Where the application has been abandoned for failure to respond to an Office action, applicant’s only option would be to file a timely petition to revive the application, which, if granted, would allow the application to return to live status.  See 37 C.F.R. §2.66; TMEP §1714.  There is a $100 fee for such petitions.  See 37 C.F.R. §§2.6, 2.66(b)(1).

 

Trademark Counsel Suggested

Because of the legal technicalities and strict deadlines involved in the USPTO application process, applicant may wish to hire a qualified U.S. attorney specializing in trademark matters to represent applicant in this process and provide legal advice.  Although the undersigned trademark examining attorney is permitted to help an applicant understand the contents of an Office action as well as the application process in general, no USPTO attorney or staff is permitted to give an applicant legal advice or statements about an applicant’s legal rights.  TMEP §§705.02, 709.06.  For attorney referral information, applicant may consult the American Bar Association’s Consumers’ Guide to Legal Help at http://www.abanet.org/legalservices/findlegalhelp/home.cfm.  The USPTO may not assist an applicant in the selection of an attorney.  37 C.F.R. §2.11.

WHO IS PERMITTED TO RESPOND TO THIS PROVISIONAL FULL REFUSAL:  Any response to this provisional refusal must be personally signed by an individual applicant, all joint applicants, or someone with legal authority to bind a juristic applicant (e.g., a corporate officer or general partner).  37 C.F.R. §§2.62(b), 2.193(e)(2)(ii); TMEP §712.01.  If applicant hires a qualified U.S. attorney to respond on his or her behalf, then the attorney must sign the response.  37 C.F.R. §§2.193(e)(2)(i), 11.18(a); TMEP §§611.03(b), 712.01.  Qualified U.S. attorneys include those in good standing with a bar of the highest court of any U.S. state, the District of Columbia, Puerto Rico, and other federal territories and possessions of the United States.  See 37 C.F.R. §§2.17(a), 2.62(b), 11.1, 11.14(a); TMEP §§602, 712.01.  Additionally, for all responses, the proper signatory must personally sign the document or personally enter his or her electronic signature on the electronic filing.  See 37 C.F.R. §2.193(a); TMEP §§611.01(b), 611.02.  The name of the signatory must also be printed or typed immediately below or adjacent to the signature, or identified elsewhere in the filing.  37 C.F.R. §2.193(d); TMEP §611.01(b).

 

In general, foreign attorneys are not permitted to represent applicants before the USPTO (e.g., file written communications, authorize an amendment to an application, or submit legal arguments in response to a requirement or refusal).  See 37 C.F.R. §11.14(c), (e); TMEP §§602.03-.03(b), 608.01.
