This is a PROVISIONAL FULL REFUSAL of the trademark and/or service mark in the above-referenced U.S. application.  See 15 U.S.C. §1141h(c).

 

WHO IS PERMITTED TO RESPOND TO THIS PROVISIONAL FULL REFUSAL:

 

Applicant may respond directly to this provisional refusal Office action if applicant is not represented by an authorized attorney.  See 37 C.F.R. §2.193(e)(2)(ii).  Otherwise, applicant’s authorized attorney must respond on applicant’s behalf.  See 37 C.F.R. §2.193(e)(2)(i).  However, the only attorneys who are authorized to sign responses and practice before the USPTO in trademark matters are as follows:

 

(1)  Attorneys in good standing with a bar of the highest court of any U.S. state, the District of Columbia, Puerto Rico, and other federal territories and possessions of the United States; and

 

(2)  Canadian agents/attorneys who represent applicants located in Canada and (a) are registered with the USPTO and in good standing as patent agents or (b) have been granted reciprocal recognition by the USPTO.

Foreign attorneys, other than authorized Canadian attorneys, are not permitted to represent applicants before the USPTO.  See 37 C.F.R. §§2.17(e), 11.14(c), (e); TMEP §602.03-.03(b).  That is, foreign attorneys may not file written communications, authorize an amendment to an application, or submit legal arguments in response to a requirement or refusal, among other things.  See 37 C.F.R. §11.5(b)(2); TMEP §§602.03(c), 608.01.  If applicant is represented by such a foreign attorney, applicant must respond directly to this provisional refusal Office action.  See 37 C.F.R. §2.193(e)(2)(ii).

 

DESIGNATION OF DOMESTIC REPRESENTATIVE:

 

The USPTO encourages applicants who do not reside in the U.S. to designate a domestic representative upon whom notices or process may be served.  15 U.S.C. §§1051(e), 1141h(d); 37 C.F.R. §2.24(a)(1)-(2); see TMEP §610.  Such designations may be filed online at http://www.gov.uspto.report/teas/index.html. 

 

THE APPLICATION HAS BEEN PROVISIONALLY REFUSED AS FOLLOWS:

 

The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

In any event, applicant should note the following refusal to register. 

 

SECTION 2(b) REFUSAL TO REGISTER—COAT OF ARMS

 

Registration is refused because the applied-for mark includes Australia’s coat of arms.  Trademark Act Section 2(b), 15 U.S.C. §1052(b); see TMEP §1204.  Trademark Act Section 2(b) bars registration of marks that include the flag, coat of arms, or other insignia of the United States, any state or municipality, or any foreign nation.  TMEP §1204.

 

The attached evidence from USPTO’s X-Search database shows that the applied-for mark includes the coat of arms from the Commonwealth of Australia.

 

Flags and coats of arms of governments are designs that have been formally adopted to serve as emblems of governmental authority.  U.S. Navy v. U.S. Mfg. Co., 2 USPQ2d 1254 (TTAB 1987); In re U.S. Dep’t of the Interior, 142 USPQ 506 (TTAB 1964); TMEP §1204.02(a).

 

Trademark Act Section 2(b) is an absolute bar to registration on the Principal and Supplemental Registers.  Trademark Act Sections 2(b) and 23(a), (c), 15 U.S.C. §§1052(b), 1091(a), (c); see TMEP §§1204, 1204.04(a).

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration.

 

Applicant must respond to the requirements set forth below.

 

DISCLAIMER REQUIRED

 

Applicant must disclaim the geographically descriptive and descriptive wording “AUSTRALIAN GOVERNMENT” AND “AUSTRALIA” apart from the mark as shown because it is primarily geographically descriptive of the origin of applicant’s goods and/or services and merely describes an ingredient, quality, characteristic, function, feature, purpose or use of applicant’s goods and/or services.  See 15 U.S.C. §§1052(e)(1), 1056(a); In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420, 1421 (Fed. Cir. 2005); In re Gyulay, 820 F.2d 1216, 1217-18, 3 USPQ2d 1009, 1010 (Fed. Cir. 1987); In re Societe Generale des Eaux Minerales de Vittel S.A., 824 F.2d 957, 959, 3 USPQ2d 1450, 1451-52 (Fed. Cir. 1987); In re Joint-Stock Co. “Baik”, 80 USPQ2d 1305, 1309 (TTAB 2006);  TMEP §§1213, 1213.03(a); TMEP §§1210.01(a), 1210.06(a), 1213.03(a).

 

The word “AUSTRALIA” means “The world's smallest continent, southeast of Asia between the Pacific and Indian oceans                                                                                                                                                ,” the word “AUSTRALIAN” means “[o]f or relating to Australia or its peoples, languages, or cultures,” and “Ecology Of, relating to, or being the zoogeographic region that includes Australia and the islands adjacent to it, including New Guinea, New Zealand, Polynesia, and Tasmania,” and the word “GOVERNMENT” means “The office, function, or authority of a governing individual or body.”  See the attached Yahoo® evidence.  This evidence shows that Australia is a generally known geographic place or location.  See TMEP §§1210.02 et seq.  The goods and/or services for which applicant seeks registration originate in this geographic place or location as shown by applicant’s location there.  See TMEP §1210.03.  When there is no genuine issue that the geographical significance of a term is its primary significance, and the geographical place is neither obscure nor remote, a public association of the goods and/or services with the place is presumed if an applicant’s goods and/or services originate in the place named in the mark.  TMEP §1210.04; see, e.g., In re Cal. Pizza Kitchen Inc., 10 USPQ2d 1704, 1706 (TTAB 1988) (holding CALIFORNIA PIZZA KITCHEN primarily geographically descriptive of restaurant services rendered in California); In re Handler Fenton Ws., Inc., 214 USPQ 848, 849-50 (TTAB 1982) (holding DENVER WESTERNS primarily geographically descriptive of western-style shirts originating in Denver).  Further, the wording “AUSTRALIAN GOVERNMENT” identifies the source of the goods and services.  A word or term that identifies the source or provider of a product or service, using only descriptive wording, is merely descriptive under Trademark Act Section 2(e)(1).  See In re Major League Umpires, 60 USPQ2d 1059 (TTAB 2001) (holding MAJOR LEAGUE UMPIRE merely descriptive of clothing, face masks, chest protectors and skin guards); In re The Phone Co., 218 USPQ 1027 (TTAB 1983) (holding THE PHONE COMPANY merely descriptive for telephones); TMEP §1209.03(q).

 

Applicant may submit the following standardized format for a disclaimer:

                       

No claim is made to the exclusive right to use “AUSTRALIAN GOVERNMENT” AND “AUSTRALIA” apart from the mark as shown.

 

TMEP §1213.08(a)(i); see In re Owatonna Tool Co., 231 USPQ 493 (Comm’r Pats. 1983).

 

A “disclaimer” is a statement that applicant does not claim exclusive rights to an unregistrable component of a mark; it does not affect the appearance of the mark.  TMEP§1213.  An unregistrable component of a mark includes wording and designs that are merely descriptive or generic and primarily geographically descriptive of the goods and/or services, and is wording or an illustration that others would need to use to describe or show their goods and services in the marketplace.  15 U.S.C. §1052(e); see TMEP §§1209.03(f), 1213.03 et seq.

 

CLARIFICATION REQUIRED REGARDING COLOR

 

The drawing shows the mark in color; however, the application does not explicitly state whether color is a feature of the mark.  Applications for marks depicted in color must include a statement listing all the colors claimed as a feature of the mark and a statement describing the literal and design elements in the mark that specifies where all the colors appear in those elements.  37 C.F.R. §§2.37, 2.52(b)(1); see TMEP §§807.07(a) et seq.  Because of the omission of a color claim and mark description referencing color, the application is unclear as to whether applicant intends to claim color as a feature of the mark sought to be registered.

 

Therefore, applicant must clarify whether color is claimed as a feature of the applied-for mark by satisfying one of the following:

 

(1)  If color is a feature of the mark, applicant must submit a statement listing all of the colors that are claimed as a feature of the mark and a statement describing the literal and design elements in the mark that specifies where all the colors appear in those elements.  See 37 C.F.R. §§2.37, 2.52(b)(1); TMEP §§807.07(a)(i)-(b), 1011.01.  If black, white and/or gray appear in the mark and are not being claimed as colors, applicant must include a statement that the colors black, white, and/or gray represent background, outlining, shading and/or transparent areas and are not part of the mark.  TMEP §807.07(d)(iii).  Generic color names must be used, e.g., magenta, yellow, turquoise.  TMEP §807.07(a)(i)-(a)(ii).  The following format is suggested: The colors {specify colors, e.g. black, yellow, orange, and white} are claimed as a feature of the mark.  The mark consists of the following:  a yellow angled line pointing to the left and a yellow and orange broken angled line pointing to the right with the black wording “AUSTRALIAN GOVERNMENT” in the lower right corner with a design of a black and white emblem featuring a kangaroo, a duck, the black wording “AUSTRALIA” and {indicate other components of design}.”; or

 

(2)  If color is not a feature of the mark, applicant must submit a new drawing showing the mark only in black and white and provide a statement that no claim of color is made with respect to the mark in the international registration.  TMEP §§807.07(b), 807.12(c).

 

DESCRIPTION OF MARK REQUIRED

 

The applied-for mark is not in standard characters and applicant did not provide a description of the mark with the initial application.  Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies literal elements as well as any design elements.  See 37 C.F.R. §2.37; TMEP §§808.01, 808.02, 808.03(b). 

 

Therefore, applicant must provide a description of the applied-for mark.  Please note that a thorough color location description will obviate this requirement, but if color is not claimed as a feature of the mark, applicant must nevertheless submit a mark description. 

 

The following is suggested, if color is not claimed as a feature of the mark, if accurate:

 

The mark consists of the following:  a yellow angled line pointing to the left and a yellow and orange broken angled line pointing to the right with the black wording “AUSTRALIAN GOVERNMENT” in the lower right corner with a design of a black and white emblem featuring a kangaroo, a duck, the wording “AUSTRALIA” and {indicate other components of design}.”

The wording bolded below in the identification of goods and/or services is indefinite and/or too broad and must be clarified.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  Applicant must specify the common commercial or generic name for the goods.  If there is no common commercial or generic name, applicant must describe the product and intended consumer as well as its main purpose and intended uses.  Applicant must specify the common commercial or generic name for the services.  If the services have no common commercial or generic name, applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s). 

 

Furthermore, the identification of goods and/or services contains parentheses.  Generally, parentheses and brackets should not be used in identifications.  Parenthetical information is permitted in identifications only if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such a way that it does not affect the clarity of the identification, e.g., “obi (Japanese sash).”  TMEP §1402.12.  Therefore, applicant must remove the parentheses from the identification of goods and/or services and incorporate the parenthetical information into the description.

In an application filed under Trademark Act Section 66(a), an applicant may not change the classification of goods and/or services from that assigned by the International Bureau in the corresponding international registration.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b).  Further, in a multiple-class Section 66(a) application, an applicant may not transfer goods and/or services from one existing international class to another.  37 C.F.R. §2.85(d); see TMEP §§1402.07(a), 1904.02(c).
