STRICT DEADLINE TO RESPOND TO THIS LETTER

TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.

This action responds to applicant’s communication filed February 16, 2011, wherein applicant provided the required disclaimer, an acceptable mark description statement, and amended the identification of goods.   Unfortunately, the wording “orthopedic articles” in the identification is unacceptable and requires clarification as discussed in the requirement below.  The examining attorney apologizes for the oversight and any inconvenience this may have caused.

 

IDENTIFICATION UNACCEPTABLE - REQUIREMENT

Applicant has identified the following:

 

Medical apparatus and instruments for use in orthopedic surgery; orthodontic appliances; dental apparatus, namely drills; radiotherapy apparatus; furniture especially made for medical purposes, namely operating and patient examination tables.; baby bottles; contraceptives, non-chemical; surgical implants comprising artificial material; orthopedic articles; suture materials

 

Unfortunately, the italicized wording above is insufficiently definite for registration purposes.  See TMEP §1402.01. Applicant must identify the type or purpose of these goods, e.g. orthopedic apparatus and instruments for diagnostic and therapeutic use, orthopedic belts, etc.

 

Applicant may adopt the following, if accurate

 

“Medical apparatus and instruments for use in orthopedic surgery; orthodontic appliances; dental apparatus, namely drills; radiotherapy apparatus; furniture especially made for medical purposes, namely operating and patient examination tables.; baby bottles; contraceptives, non-chemical; surgical implants comprising artificial material; orthopedic articles, namely orthopedic apparatus and instruments for diagnostic and therapeutic use; suture materials” in Class 010.

 

Identifications of goods and/or services can be amended only to clarify or limit the goods and/or services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.
