INTERNATIONAL REGISTRATION NO. 0969955

 

After a periodic review of the suspended application the following has been determined:

 

The potential likelihood of confusion with U.S. Application Serial No. 77364252 is withdrawn following the abandonment of the cited application. 

 

However, the following requirements are now made FINAL:  clarification of the identification of goods and a claim of ownership of the applicant’s prior registration.  See37 C.F.R. §2.64(a).

 

Identification of Goods

The wording “bets” in Class 025 the identification of goods is indefinite and must be clarified because its misspelling creates confusion as to the actual meaning of the term.  See TMEP §§1402.01, 1402.03.

 

The international classification of goods and/or services in applications filed under Trademark Act Section 66(a) cannot be changed from the classification the International Bureau assigned to the goods and/or services in the corresponding international registration.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b).

 

Therefore, any modification to this wording must identify goods in International Class 008, 013, 025 and 028, the classification specified in the application for these goods.

 

The following substitute wording is suggested, if appropriate:

 

Class 025: Clothing, namely anoraks, blazers, flight suits, jackets, overalls, raincoats, dress shirts, pullovers, t-shirts, sweaters, belts for clothing, socks; footwear, headgear

 

The goods in Class 008, 013 and 028 are acceptable and require no further amendment.

 

See TMEP §1402.01.

 

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

Prior Registration

If applicant is the owner of U.S. Registration No. 1594109, then applicant must submit a claim of ownership.  37 C.F.R. §2.36; TMEP §812.  The following standard format is suggested:

 

            Applicant is the owner of U.S. Registration No. 1594109.

 

Applicant’s Response

If applicant does not respond within six months of the date of issuance of this final Office action, the application will be abandoned.  15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).  Applicant may respond to this final Office action by:

 

(1)  Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or

 

(2)  Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.

In certain rare circumstances, a petition to the Director may be filed pursuant to 37 C.F.R. §2.63(b)(2) to review a final Office action that is limited to procedural issues.  37 C.F.R. §2.64(a); TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining petitionable matters).  The petition fee is $100.  37 C.F.R. §2.6(a)(15).
