A Combined Sections 71 & 15 Affidavit was received on October 1, 2018. The Section 71 portion of the Combined Affidavit is accepted. However, the Office cannot acknowledge the Section 15 portion for the reason(s) set forth below.
Duplicate sect 15
The Section 15 portion, filed on October 1, 2018. , is considered a duplicate and will not be reviewed. A section 15 Affidavit was submitted previously on June 9, 2014, and accepted. However, to avoid cancellation and expiration of your registration, you must submit a newly executed 71 Renewal Application on or between November 4, 2027 and November 4, 2028, or during the grace period that ends on May 4, 2029. 15 U.S.C. §§1058(a), 1059(a); 37 C.F.R. §§2.160, 2.182. To ensure timely submission, you are encouraged to file your Section 8 Affidavit of Use and Section 9 Renewal Application via the Trademark Electronic Application System (TEAS) online at http://www.gov.uspto.report/teas/index.html.
The duplicate Combined Affidavit documentation will remain in the record; i.e., it will not be returned to you and will not be processed or reviewed. See TMEP §1604.04(a). The section 15 fees submitted with the duplicate Combined Affidavit will be refunded in due course and cannot be applied to any subsequent submissions.
The USPTO is tasked with preserving the integrity of its administrative record and providing the public with a complete registration file. See, e.g., 35 U.S.C. §§143, 144. Once a document has been filed with respect to an application or registration, it becomes part of the public record and will not be returned or removed. 37 C.F.R. §2.25; TMEP §404. Moreover, if any goods or services were deleted in a previous affidavit, they cannot be added to the registration in a substitute affidavit. See TMEP §1604.09(d).
