MISCELLANEOUS STATEMENT REQUEST FOR CORRECTED CERTIFICATE OF REGISTRATION AND CORRECTION OF MISTAKE IN UNITED STATES PATENT AND TRADEMARK OFFICE RECORDS DUE TO OFFICE ERROR Pursuant to Section 7(g) of the Trademark Act, 37 C.F.R. §2.174, and TMEP §1609.10(a) regarding correction of USPTO errors, it is requested that a corrected Certificate of Registration be issued for United States Trademark Registration No. 3,492,888 (BODYSENSE) and a correction of mistake be made in USPTO records for the instant Registration to show the correct name of the Registrant. On June 13, 2008, the Applicant submitted a Request for Correction of Mistake in the USPTO Trademark Official Gazette and Records due to Office Error. The publication of the application for the instant registration in the Trademark Official Gazette of June 10, 2008 contained a typographical error in the name of the Applicant. As shown on the attached copy of International Registration No. 935227 which the instant registration is an extension of (Exhibit A), the correct name of the Registrant is “IEE International Electronics & Engineering S.A.” without a semi-colon after the word “International.” The same typographical error appeared on the Trademark Electronic Search System database and the Trademark Applications and Registrations Retrieval relating to the application for the instant registration. Therefore, the Applicant requested on June 13, 2008 that a correction of typographical error be made in the USPTO Trademark Official Gazette and records to show the correct name of the Applicant. On August 26, 2008, the instant application matured into registration, and the Patent and Trademark Office issued a Certificate of Registration. Unfortunately, this Certificate still contains the same typographical error in the name of the Registrant. This typographical error also appears on the Trademark Electronic Search System database and the Trademark Applications and Registrations Retrieval relating to the instant registration. Therefore, it is respectfully requested that a corrected Certificate of Registration be issued for U.S. Trademark Registration No. 3,492,888 and a correction of mistake be made in USPTO records for the instant Registration to show the correct name of the Registrant. In the event there are any queries regarding the instantly submitted Request, the Registrant’s Attorney respectfully requests the courtesy of a telephone conference to discuss any matters in need of attention. Since the issuance of a corrected Certificate of Registration is requested as a result of an error by the PTO, no fee should be involved. 15 U.S.C. §1057(g); 37 C.F.R. §2.174.
