The assigned examining attorney has reviewed the referenced application and determined the following.

 

No Conflicting Marks Found

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.  However, the applicant must address the following informalities.

 

Identification and Classification of Goods

The wording “bicycle tools” and “bicycle tire mounting levers” in the identification of goods is indefinite and must be clarified because it does not identify the goods with the preciseness required for classification.  TMEP §1402.01.  In the identification of goods, applicant must use the common commercial or generic names for the goods, be as complete and specific as possible, and avoid the use of indefinite words and phrases.  TMEP §§1402.01 and 1402.03(a).  Finally, the applicant must specify the components of the repair kits.

 

Applicant may substitute the following wording, if accurate.

 

Manually operated bicycle tools, namely, [specify, e.g., spoke wrenches, tire levers] in International Class 008.

 

Bicycle tires and bicycle tire repair kits comprising [identify the components]; bicycle tubes and bicycle tube repair kits comprising [identify the components]; bicycle chains and bicycle chain repair kits comprising [identify the components]; bicycle pumps in International Class 012.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of the goods listed in the present identification.  For assistance regarding an acceptable listing of goods and/or services, please see the on‑line searchable Manual of Acceptable Identifications of Goods and Services, at http://www.gov.uspto.report/web/offices/tac/doc/gsmanual/.
